0012| RELATING TO COUNTY INDIGENT HEALTH CARE; PROVIDING FOR FUNDING
|
0013| AND EXPENDITURE OF FUNDS.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 27-5-7 NMSA 1978 (being Laws 1965,
|
0017| Chapter 234, Section 7, as amended) is amended to read:
|
0018| "27-5-7. COUNTY INDIGENT HOSPITAL CLAIMS FUND.--
|
0019| A. There is created in the county treasury of each
|
0020| county a "county indigent hospital claims fund".
|
0021| B. Collections under the levy made pursuant to the
|
0022| Indigent Hospital and County Health Care Act and all payments
|
0023| shall be placed into the fund, and the amount placed in the fund
|
0024| shall be budgeted and expended only for the purposes specified
|
0025| in the Indigent Hospital and County Health Care Act, by warrant
|
0001| upon vouchers approved by a majority of the board and signed by
|
0002| the chairman of the board. Payments for indigent
|
0003| hospitalizations shall not be made from any other county fund.
|
0004| C. The fund shall be audited in the manner that
|
0005| other state and county funds are audited, and all records of
|
0006| payments and verified statements of qualification upon which
|
0007| payments were made from the fund shall be open to the public.
|
0008| D. Any balance remaining in the fund at the end of
|
0009| the fiscal year [pursuant to Subsections F and G of this
|
0010| section] shall carry over into the ensuing fiscal year and
|
0011| [that balance] shall be taken into consideration in the
|
0012| determination of the ensuing fiscal year's budget and
|
0013| certification of need for purposes of making a tax levy.
|
0014| E. Money may be transferred to the fund from other
|
0015| sources, but no transfers may be made from the fund for any
|
0016| purpose other than those specified in the Indigent Hospital and
|
0017| County Health Care Act.
|
0018| F. On June 30 of each fiscal year, beginning in
|
0019| fiscal year 1996, the board [shall tranfer] may transfer
|
0020| to the county-supported medicaid fund [that] any amount of
|
0021| the balance in the county indigent hospital claims fund that
|
0022| exceeds two hundred thousand dollars ($200,000) or [that
|
0023| exceeds the] an amount equal to thirty percent of the income
|
0024| to the fund during that fiscal year, whichever is greater.
|
0025| [Beginning in 1996, the] Any such transfer shall be made by
|
0001| September 1 [of each] following the end of the fiscal year.
|
0002| Any amount transferred to the county-supported medicaid fund
|
0003| pursuant to this subsection is in addition to the county's
|
0004| obligation pursuant to Section 27-10-4 NMSA 1978."
|
0005| Section 2. Section 27-5-7.1 NMSA 1978 (being Laws 1993,
|
0006| Chapter 321, Section 16) is amended to read:
|
0007| "27-5-7.1. COUNTY INDIGENT HOSPITAL CLAIMS FUND--AUTHORIZED USES OF THE FUND.--
|
0008| A. The fund shall be used:
|
0009| (1) to meet the county's contribution for
|
0010| support of sole community provider payments as calculated by the
|
0011| department for that county; [and]
|
0012| (2) to pay all claims that have been approved
|
0013| by the board that are not matched with federal funds under the
|
0014| state medicaid program; and
|
0015| (3) to pay health care provider claims for
|
0016| primary care of indigent patients.
|
0017| B. The fund may be used to meet the county's
|
0018| obligation under Section 27-10-4 NMSA 1978.
|
0019| C. Until June 30, 1996, the cash reserves from the
|
0020| fund may be used to meet the county's obligation under Section
|
0021| 27-10-4 NMSA 1978."

0021| care to indigent patients, that meet the requirements specified in
|
0022| Paragraph (5) of Subsection N of Section 27-5-4 NMSA 1978 and that
|
0023| have a governing board, the majority of whose membership is
|
0024| composed of consumer representatives from the area served.".,
