0014| SCHOLARSHIPS FOR ACTIVE MEMBERS OF THE NEW MEXICO ARMY NATIONAL

0015| GUARD AND THE NEW MEXICO AIR NATIONAL GUARD; MAKING AN
|
0016| APPROPRIATION.

0018| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0019| Section 1. Section 21-1-2 NMSA 1978 (being Laws 1970,
|
0020| Chapter 9, Section 1, as amended by Laws 1989, Chapter 44,
|
0021| Section 3 and by Laws 1989, Chapter 45, Section 3 and also by
|
0022| Laws 1989, Chapter 68, Section 1) is amended to read:
|
0023| "21-1-2. MATRICULATION AND TUITION FEES.--
|
0024| A. Except as otherwise provided in this section, the
|
0025| boards of regents of the university of New Mexico, New Mexico
|
0001| state university, New Mexico highlands university, western New
|
0002| Mexico university, eastern New Mexico university, New Mexico
|
0003| military institute, New Mexico institute of mining and
|
0004| technology and New Mexico junior college shall establish and
|
0005| charge matriculation fees and tuition fees as follows:
|
0006| (1) each student shall be charged a
|
0007| matriculation fee of not less than five dollars ($5.00) upon
|
0008| enrolling in each institution;
|
0009| (2) each student who is a resident of New
|
0010| Mexico shall be charged a tuition fee of not less than twenty
|
0011| dollars ($20.00) a year;
|
0012| (3) each student who is not a resident of New
|
0013| Mexico shall be charged a tuition fee of not less than fifty
|
0014| dollars ($50.00) a year;
|
0015| (4) each student shall be charged a tuition fee
|
0016| of not less than ten dollars ($10.00) for each summer session;
|
0017| and
|
0018| (5) each student may be charged a tuition fee
|
0019| for extension courses.
|
0020| B. Except as otherwise provided in this section, the
|
0021| board of regents of northern New Mexico state school shall
|
0022| establish and charge each student a matriculation fee and a
|
0023| tuition fee.
|
0024| C. The board of regents of each institution may
|
0025| establish and grant gratis scholarships to students who are
|
0001| residents of New Mexico by waiving the matriculation fee or
|
0002| tuition and fees, or both. The number of scholarships
|
0003| established and granted shall not exceed three percent of the
|
0004| preceding fall semester enrollment in each institution and shall
|
0005| not be established and granted for summer sessions. The
|
0006| president of each institution shall select and recommend to the
|
0007| board of regents of his institution, as recipients of
|
0008| scholarships, students who possess good moral character and
|
0009| satisfactory initiative, scholastic standing and personality.
|
0010| At least thirty-three and one-third percent of the gratis
|
0011| scholarships established and granted by each board of regents
|
0012| each year shall be granted on the basis of financial need.
|
0013| D. The board of regents of each institution set out
|
0014| in this subsection may establish and grant, in addition to those
|
0015| scholarships provided for in Subsection C of this section,
|
0016| athletic scholarships by waiving tuition and fees. In no event
|
0017| shall the board of regents of any institution be allowed to
|
0018| waive the tuition and fees for more than the number of athletic
|
0019| scholarships set out in this subsection and in no event shall
|
0020| more than seventy-five percent of the waivers granted be for
|
0021| out-of-state residents:
|
0022| (1) the board of regents of the university of
|
0023| New Mexico may grant up to two hundred ninety-three athletic
|
0024| scholarships;
|
0025| (2) the board of regents of New Mexico state
|
0001| university may grant up to two hundred seventy athletic
|
0002| scholarships;
|
0003| (3) the boards of regents of New Mexico
|
0004| highlands university, eastern New Mexico university and western
|
0005| New Mexico university may each grant up to one hundred forty
|
0006| athletic scholarships; and
|
0007| (4) the board of regents of New Mexico junior
|
0008| college [board] may grant up to fifty-two athletic
|
0009| scholarships.
|
0010| E. Notwithstanding the provisions of Subsection D of
|
0011| this section, in computing tuition credits the commission on
|
0012| higher education shall accept the value of waivers of tuition
|
0013| and fees established by the boards of regents of the university
|
0014| of New Mexico, New Mexico state university, eastern New Mexico
|
0015| university, western New Mexico university and New Mexico
|
0016| highlands university for athletes for the seventy-eighth fiscal
|
0017| year and all fiscal years thereafter. In no event shall the
|
0018| board of regents of any such institution be allowed to waive the
|
0019| tuition and fees for more than the number of athletic
|
0020| scholarships permitted that institution by regulations and
|
0021| bylaws of the national collegiate athletic association or the
|
0022| national association of intercollegiate athletics of which that
|
0023| institution is a member.
|
0024| F. Matriculation fees and tuition fees shall be
|
0025| fixed and made payable as directed by the board of regents of
|
0001| each institution, collected by the officers of each institution
|
0002| and accounted for as are other funds of the institutions.
|
0003| Matriculation fees shall be charged only once for each
|
0004| institution in which a student enrolls.
|
0005| G. The board of regents of each institution shall
|
0006| grant, in addition to those scholarships provided for in
|
0007| Subsection C of this section, scholarships to students who are
|
0008| residents of New Mexico and who are active members of the New
|
0009| Mexico army national guard or the New Mexico air national guard
|
0010| by waiving the matriculation fee and seventy-five percent of the
|
0011| tuition. The adjutant general of the department of military
|
0012| affairs shall establish criteria for eligibility and suspension
|
0013| of eligibility for national guard members who qualify for
|
0014| scholarships. National guard members shall meet each
|
0015| institution's criteria for enrollment in the program in which
|
0016| they are participating."
|
0017| Section 2. APPROPRIATION.--Six hundred fifty thousand
|
0018| dollars ($650,000) is appropriated from the general fund to the
|
0019| commission on higher education for expenditure in fiscal year
|
0020| 1997 for the purpose of granting scholarships to students who
|
0021| are residents of New Mexico and who are active members of the
|
0022| New Mexico army national guard or the New Mexico air national
|
0023| guard. The commission shall budget and fund this program in
|
0024| succeeding fiscal years. Any unexpended or unencumbered balance
|
0025| remaining at the end of fiscal year 1997 shall revert to the
|
0001| general fund.
