0012| RELATING TO CRIMINAL LAW; CHANGING THE ELEMENTS OF THE CRIME OF

0013| ROBBERY; AMENDING A SECTION OF THE CRIMINAL CODE.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 30-16-2 NMSA 1978 (being Laws 1963,
|
0017| Chapter 303, Section 16-2, as amended) is amended to read:
|
0018| "30-16-2. ROBBERY.--Robbery consists of the theft or
|
0019| retention immediately after a theft of anything of value from
|
0020| the person of another or from the immediate control of another
|
0021| by use or threatened use of force or violence.
|
0022| Whoever commits robbery is guilty of a third degree felony.
|
0023| Whoever commits robbery while armed with a deadly weapon
|
0024| is, for the first offense, guilty of a second degree felony and,
|
0025| for second and subsequent offenses, [is] guilty of a first
|
0001| degree felony."
|
0002| Section 2. EFFECTIVE DATE.--The effective date of the
|
0003| provisions of this act is July 1, 1996.
