0012| AMENDING SECTION 72-1-2.1 NMSA 1978 (BEING LAWS 1991, CHAPTER

0013| 34, SECTION 1) PERTAINING TO THE RECORDING OF CHANGES IN
|
0014| OWNERSHIP OF WATER RIGHTS.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 72-1-2.1 NMSA 1978 (being Laws 1991,
|
0018| Chapter 34, Section 1) is amended to read:
|
0019| "72-1-2.1. WATER RIGHTS--CHANGE IN OWNERSHIP--FILING AND
|
0020| RECORDING--CONSTRUCTIVE NOTICE.--In the event of any changes of
|
0021| ownership of a water right, whether by sale, gift or any other
|
0022| type of conveyance, affecting the title to [the] a water
|
0023| right that has been permitted or licensed by the state
|
0024| [engineer's office] engineer, has been declared with the
|
0025| state [engineer's office] engineer or has been adjudicated
|
0001| and is evidenced by a subfile order, partial final decree, final
|
0002| decree or any other court order, the new owner of the water
|
0003| right shall file a [state engineer] change of ownership form
|
0004| with the state engineer. The form shall include all
|
0005| information required by the state engineer and shall be
|
0006| accompanied by a copy of a warranty deed or other instrument of
|
0007| conveyance. The new owner shall record a copy of the change of
|
0008| ownership form filed with the state engineer with the clerk of
|
0009| the county [or counties] in which the water right is located
|
0010| [and the clerk shall forward an endorsed copy to the state
|
engineer's office for filing in its records]. The filing shall
|
0012| be public notice of the existence and contents of the
|
0013| instruments so recorded from the time of recording with the
|
0014| county clerk."
