0012| AMENDING A SECTION OF THE PUBLIC SCHOOL FINANCE ACT TO REMOVE

0013| THE REQUIREMENT THAT SCHOOL DISTRICTS EMPLOY DEPARTMENT-CERTIFIED NURSES.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. That version of Section 22-8-9 NMSA 1978 (being
|
0017| Laws 1967, Chapter 16, Section 63, as amended) that is to become
|
0018| effective July 1, 1996 is amended to read:
|
0019| "22-8-9. BUDGETS--MINIMUM REQUIREMENTS.--
|
0020| A. No budget for a school district shall be approved
|
0021| by the department that does not provide for:
|
0022| (1) a school year consisting of at least one
|
0023| hundred eighty full instructional days or the equivalent
|
0024| thereof, exclusive of any release time for in-service training;
|
0025| or
|
0001| (2) a variable school year consisting of a
|
0002| minimum number of instructional hours established by the state
|
0003| board; and
|
0004| (3) a pupil-teacher ratio or class or teaching
|
0005| load as provided in Section 22-2-8.2 NMSA 1978 [and
|
0006| (4) a full-time, department-certified nurse for
|
0007| each fifty-five teachers employed by a school district or the
|
0008| equivalent part-time department-certified nurse for less than
|
0009| fifty-five teachers].
|
0010| B. The state board shall, by regulation, establish
|
0011| the requirements for a teaching day, the standards for an
|
0012| instructional hour and the standards for a full-time certified
|
0013| classroom instructor and for the equivalent thereof.
|
0014| C. The local school board shall submit a plan for
|
0015| the implementation of an alternate school year to the state
|
0016| superintendent for his approval.
|
0017| D. The provisions of Subsection C and Paragraph (2)
|
0018| of Subsection A of this section shall [be construed to] apply
|
0019| only to school districts with a MEM of [1,000] one thousand
|
0020| or fewer."
