0013| CREATING THE LEGISLATIVE HEALTH CARE TASK FORCE; MAKING AN
|
0014| APPROPRIATION; DECLARING AN EMERGENCY.
|

|
0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. HEALTH CARE TASK FORCE CREATED--TERMINATION.--There is created a joint interim legislative task force, which
|
0018| shall be known as the "health care task force". The task force
|
0019| shall function from the date of its appointment until the first
|
0020| day of December prior to the first session of the forty-fourth
|
0021| legislature.
|
0022| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.--
|
0023| A. The health care task force shall be composed of
|
0024| twelve voting legislative members and ten voting nonlegislative
|
0025| members. The speaker of the house of representatives shall
|
0001| appoint six members of the house of representatives, one of whom
|
0002| shall be the chairman or vice chairman of the legislative health
|
0003| and human services committee, and the president pro tempore of
|
0004| the senate shall appoint six members of the senate, one of whom
|
0005| shall be the chairman or vice chairman of the legislative health
|
0006| and human services committee. The speaker of the house of
|
0007| representatives and the president pro tempore of the senate
|
0008| shall designate the chairman and vice chairman of the task
|
0009| force.
|
0010| B. Members of the health care task force shall be
|
0011| appointed from each house to give the two major political
|
0012| parties in each house the same proportional representation on
|
0013| the task force as prevails in each house; however, in no event
|
0014| shall either party have less than one member from each house on
|
0015| the task force. Vacancies on the task force shall be filled by
|
0016| appointment in the same manner as the original appointments.
|
0017| C. No action shall be taken by the health care task
|
0018| force if a majority of the total membership from either house on
|
0019| the health care task force rejects such action.
|
0020| D. The nonlegislative members of the health care
|
0021| task force who do not serve ex officio shall be appointed by the
|
0022| speaker of the house of representatives and the president pro
|
0023| tempore of the senate as follows:
|
0024| (1) two public members representing the
|
0025| business community, one representing small employers and one
|
0001| representing large employers;
|
0002|
|
0003| (2) a public member who is an attorney with
|
0004| expertise in the area of health care;
|
0005| (3) a health care reform advocate; and
|
0006| (4) two members of a Native American nation,
|
0007| tribe or pueblo of this state.
|
0008| E. The additional nonlegislative members shall be:
|
0009| (1) the secretary of human services or the
|
0010| secretary's designee;
|
0011| (2) the secretary of health or the secretary's
|
0012| designee;
|
0013| (3) a representative of the New Mexico health
|
0014| policy commission; and
|
0015| (4) the superintendent of insurance or the
|
0016| superintendent's designee.
|
0017| F. Members may vote on all matters before the health
|
0018| care task force, but only voting legislative members may vote on
|
0019| proposed legislation.
|
0020| G. The public members shall be paid per diem and
|
0021| mileage in accordance with the provisions of the Per Diem and
|
0022| Mileage Act.
|
0023| H. Additionally, the chairman and vice chairman,
|
0024| with approval of the speaker of the house of representatives and
|
0025| the president pro tempore of the senate, may appoint an advisory
|
0001| group to the task force that includes representatives of the
|
0002| aging population with expertise in long-term care, health care
|
0003| providers, the university of New Mexico health sciences center,
|
0004| the New Mexico medical society, the New Mexico hospital and
|
0005| health systems association, the nursing profession, the
|
0006| association of counties, the municipal league, community-based
|
0007| providers, the insurance industry, consumers, employers, the
|
0008| workers' compensation administration, the retiree health care
|
0009| authority, the public school insurance authority and the risk
|
0010| management division of the general services department.
|
0011| Section 3. DUTIES.--After the health care task force
|
0012| members are appointed, the task force shall hold one
|
0013| organizational meeting to develop a work plan and budget for the
|
0014| ensuing interim. The work plan and budget shall be submitted to
|
0015| the legislative council for approval. Upon approval of the work
|
0016| plan and budget by the legislative council, the task force shall
|
0017| review health care reform issues, including making efforts to:
|
0018| A. facilitate an ongoing partnership between the
|
0019| legislative and executive branches and bring together various
|
0020| groups working on health care reforms to:
|
0021| (1) improve the health status of New Mexicans;
|
0022| (2) enhance access to medical services with a
|
0023| commitment to protecting vulnerable populations;
|
0024| (3) strengthen the currently existing local
|
0025| health care infrastructure, both private and public, to assure
|
0001| appropriate access to needed services;
|
0002| (4) protect the quality of health care from
|
0003| erosion for cost savings; and
|
0004| (5) improve the efficiency of health care
|
0005| delivery;
|
0006| B. consider and investigate the supply and
|
0007| distribution of the state's health professional work force to
|
0008| determine what providers and infrastructure are necessary for
|
0009| health care delivery, including the development of priorities
|
0010| for geographic access of health care service in the state to
|
0011| revise the composition of health professionals to meet the
|
0012| health care service needs of the state;
|
0013| C. investigate legal and regulatory issues affecting
|
0014| the health care industry, including the use of integrated health
|
0015| plans for the medicaid managed care program;
|
0016| D. oversee developments to the health information
|
0017| system, including the efforts of the health information
|
0018| alliance, the initiation of confidential health information and
|
0019| patient privacy legislation and consumer report cards;
|
0020| E. investigate the role of the university of New
|
0021| Mexico health sciences center regarding its service mission as a
|
0022| vital education institution in the state and its role in filling
|
0023| the gaps of health care service where the private sector is
|
0024| unable to deliver service;
|
0025| F. create and sustain an ongoing dialogue with
|
0001| representatives from New Mexico Indian nations, tribes and
|
0002| pueblos to discuss health care issues related to Native American
|
0003| people, the role of the Indian health service as a provider of
|
0004| health care services and the integration of the medicaid managed
|
0005| care program with the Indian health service and Indian
|
0006| communities;
|
0007| G. provide legislative oversight on the
|
0008| implementation of health care reform measures, health care
|
0009| delivery and payment proposals and changes in federal and state
|
0010| law that impact health care reform programs that become law; and
|
0011| H. recommend legislation or changes if any are found
|
0012| to be necessary to the first and second sessions of the forty-third legislature and to the first session of the forty-fourth
|
0013| legislature.
|
0014| Section 4. SUBCOMMITTEES.--Subcommittees shall be created
|
0015| only by majority vote of all members appointed to the health
|
0016| care task force and with the prior approval of the legislative
|
0017| council. A subcommittee shall be composed of at least one
|
0018| member from the senate and one member from the house of
|
0019| representatives, and at least one member of the minority party
|
0020| shall be a member of the subcommittee. All meetings and
|
0021| expenditures of a subcommittee shall be approved by the full
|
0022| task force in advance of such meeting or expenditure, and the
|
0023| approval shall be shown in the minutes of the task force.
|
0024| Section 5. REPORT.--The health care task force shall make
|
0025| a report of its findings and recommendations for the
|
0001| consideration of the first and second sessions of the forty-third legislature and the first session of the forty-fourth
|
0002| legislature. The reports and suggested legislation shall be
|
0003| made available to the legislative council, the legislative
|
0004| finance committee, the legislative health and human services
|
0005| committee and the New Mexico health policy commission on or
|
0006| before November 30 preceding each session.
|
0007| Section 6. STAFF.--The staff for the health care task
|
0008| force shall be provided by the legislative council service, and
|
0009| the staff of the New Mexico health policy commission shall
|
0010| assist the health care task force as requested. The legislative
|
0011| council service at the direction of the task force may hire
|
0012| additional staff as necessary and may contract with experts,
|
0013| including economists, actuaries and the bureau of business and
|
0014| economic research at the university of New Mexico, to assist the
|
0015| task force in carrying out its tasks.
|
0016| Section 7. APPROPRIATION.--For the purpose of paying the
|
0017| salaries and expenses of the technical, professional, legal,
|
0018| clerical and stenographic assistants; for necessary equipment
|
0019| and supplies used in carrying out the provisions of this act;
|
0020| for travel expenses for staff and task force members; and for
|
0021| reimbursing the per diem and mileage expenses of the health care
|
0022| task force, there is appropriated to the legislative council
|
0023| service from the general fund the sum of one hundred twenty-five
|
0024| thousand dollars ($125,000) for expenditure in fiscal year 1997.
|
0025| Any unexpended or unencumbered balance remaining at the end of
|
0001| fiscal year 1997 shall revert to the general fund. Payments
|
0002| from the appropriation shall be made upon vouchers signed by the
|
0003| director of the legislative council service or the director's
|
0004| authorized representative.
|
0005| Section 8. EMERGENCY.--It is necessary for the public
|
0006| peace, health and safety that this act take effect immediately.
