0012| RELATING TO PUBLIC PURCHASES; INCREASING THE AMOUNTS OF

0013| PROCUREMENT FOR SMALL PURCHASES THAT STATE AGENCIES ARE
|
0014| AUTHORIZED TO MAKE; AMENDING THE PROCUREMENT CODE.
|

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 13-1-125 NMSA 1978 (being Laws 1984,
|
0018| Chapter 65, Section 98, as amended) is amended to read:
|
0019| "13-1-125. SMALL PURCHASES.--
|
0020| A. The [state purchasing agent or] central
|
0021| purchasing office within a local public body shall procure
|
0022| services, construction or items of tangible personal property
|
0023| having a value not exceeding five thousand dollars ($5,000) in
|
0024| accordance with the applicable small purchase regulations
|
0025| adopted by [the secretary] a local public body or a central
|
0001| purchasing office that has the authority to issue regulations.
|
0002| B. Notwithstanding the requirements of Subsection A
|
0003| of this section, a central purchasing office may procure
|
0004| professional services having a value not exceeding twenty
|
0005| thousand dollars ($20,000), excluding applicable state and local
|
0006| gross receipts taxes, except for the services of architects,
|
0007| landscape architects, engineers or surveyors for state public
|
0008| works projects or local public works projects, in accordance
|
0009| with professional services procurement regulations promulgated
|
0010| by the department of finance and administration, the general
|
0011| services department or a central purchasing office with the
|
0012| authority to issue regulations.
|
0013| C. Notwithstanding the requirements of Subsection A
|
0014| of this section, a state agency or a central purchasing office
|
0015| for [a state educational institution named in Article 12,
|
0016| Section 11 of the constitution of New Mexico, for a state
|
0017| two-year post-secondary institution or for] a school district
|
0018| as defined in the Public School Code may procure services,
|
0019| construction or items of tangible personal property having a
|
0020| value not exceeding ten thousand dollars ($10,000) in accordance
|
0021| with the applicable small purchase regulations promulgated by
|
0022| the secretary or a central purchasing office with the
|
0023| authority to issue regulations.
|
0024| D. Notwithstanding the requirements of Subsection A
|
0025| of this section, a state agency or a local public body may
|
0001| procure services, construction or items of tangible personal
|
0002| property having a value not exceeding five hundred dollars
|
0003| ($500) by issuing a direct purchase order to a contractor based
|
0004| upon the best obtainable price.
|
0005| E. Procurement requirements shall not be
|
0006| artificially divided so as to constitute a small purchase under
|
0007| this section."
