0013|     SCHOOL CAPITAL IMPROVEMENTS ACT; MAKING AN APPROPRIATION.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|       Section 1.  Section 22-25-9 NMSA 1978 (being Laws 1975
    |
0017|     (S.S.), Chapter 5, Section 9, as amended by Laws 1988, Chapter
    |
0018|     64, Section 44 and also by Laws 1988, Chapter 66, Section 2) is
    |
0019|     amended to read:
    |
0020|       "22-25-9.  STATE DISTRIBUTION TO DISTRICT IMPOSING TAX
    |
0021|     UNDER CERTAIN CIRCUMSTANCES.--The <s>[director]</s> <u>state
</u>    |
<u></u>0022| <u>    superintendent</u> shall distribute to any school district that has
    |
0023|     imposed a tax under the Public School Capital Improvements Act
    |
0024|     an amount from the public school capital improvements fund that
    |
0025|     is equal to the amount by which the revenue estimated to be
    |
0001|     received from the imposed tax, at the rate certified by the
    |
0002|     department of finance and administration in accordance with
    |
0003|     Section 22-25-7 NMSA 1978, assuming a one hundred percent
    |
0004|     collection rate, is less than an amount calculated by
    |
0005|     multiplying the district's first forty-days' total program units
    |
0006|     times <s>[thirty-five dollars ($35.00)] <u>forty dollars ($40.00)</u>
</s>    |
<s></s>0007| <s>    and further multiplying the product obtained by the tax rate
</s>    |
<s></s>0008| <s>    approved by the qualified electors in the most recent election
</s>    |
<s></s>0009| <s>    on the question of imposing a tax under the Public School
</s>    |
<s></s>0010| <s>    Capital Improvements Act.  The distribution shall be made each
</s>    |
<s></s>0011| <s>    year that the tax is imposed in accordance with Section 22-25-7
</s>    |
<s></s>0012| <s>    NMSA 1978; provided that no state distribution from the public
</s>    |
<s></s>0013| <s>    school capital improvements fund may be used for capital
</s>    |
<s></s>0014| <s>    improvements to any administration building of a school
</s>    |
<s></s>0015| <s>    district.  In the event that sufficient funds are not available
</s>    |
<s></s>0016| <s>    in the public school capital improvements fund to make the state
</s>    |
<s></s>0017| <s>    distribution provided for in this section, the dollar per
</s>    |
<s></s>0018| <s>    program unit figure shall be reduced as necessary."
</s>    |
<s></s>0019| <s>      Section 2.  APPROPRIATION.--Three million three hundred
</s>    |
<s></s>0020| <s>    sixty-one thousand dollars ($3,361,000) is appropriated from the
</s>    |
<s></s>0021| <s>    general fund to the public school capital improvements fund for
</s>    |
<s></s>0022| <s>    expenditure in fiscal year 1997 for the purpose of making
</s>    |
<s></s>0023| <s>    distributions to local school districts pursuant to the Public
</s>    |
<s></s>0024| <s>    School Capital Improvements Act.  Any unexpended or unencumbered
</s>    |
<s></s>0025| <s>    balance remaining at the end of fiscal year 1997 shall not
</s>    |
