0001| AN ACT | 0002| RELATING TO CAPITAL EXPENDITURES; REAUTHORIZING UNEXPENDED OR | 0003| UNENCUMBERED BALANCES; CHANGING AGENCIES AND CONTINGENCIES OF A | 0004| CAPITAL PROGRAM FUND APPROPRIATION AND A SEVERANCE TAX BOND | 0005| AUTHORIZATION; EXTENDING PERIODS OF EXPENDITURE; MAKING | 0006| APPROPRIATIONS; DECLARING AN EMERGENCY. | 0007| | 0008| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: Section 1. CAPITAL PROGRAM FUND--CHANGE IN AGENCY--CONTINUED | 0009| AUTHORIZATION--CHANGE IN CONTINGENCY--APPROPRIATION.--The capital | 0010| program fund appropriation, pursuant to Paragraph (2) of Subsection U of Section 2 of Chapter | 0011| 6 of Laws 1990 (1st S.S.), for the construction of a home for homeless children shall be | 0012| appropriated to the local government division of the department of finance and administration to | 0013| plan, design, construct and furnish a home for homeless children in Albuquerque located in | 0014| Bernalillo county, provided that the city of Albuquerque receives a donation from a private or | 0015| public organization of a minimum of ten acres of land for constructing the home and that the city | 0016| of Albuquerque, through its child development office, executes a contract with an organization | 0017| that provides services to homeless children for the operation of the home for a minimum of ten | 0018| years. Notwithstanding the provisions of Laws 1993, Chapter 339, Section 1, any unexpended | 0019| or unencumbered balance remaining at the end of fiscal year 1999 shall revert to the capital | 0020| program fund. | 0021| Section 2. SEVERANCE TAX BONDS--CHANGE IN AGENCY--CONTINUED | 0022| AUTHORIZATION--CHANGE IN CONTINGENCY--APPROPRIATION.--The balance of the | 0023| proceeds from severance tax bonds appropriated to the general services department, pursuant to | 0024| Laws 1992, Chapter 113, Section 20, for the New Day shelter for troubled youth in Albuquerque | 0025| located in Bernalillo county shall not be expended by that agency nor be subject to the | 0001| contingency imposed but is reauthorized and appropriated to the local government division of | 0002| the department of finance and administration and shall be contingent upon the city of | 0003| Albuquerque receiving a donation from a private or public organization of a minimum of ten | 0004| acres of land for building the home, and the city of Albuquerque, through its child development | 0005| office, executing a contract with an organization that provides services to homeless children for | 0006| the operation of the home for a minimum of ten years. Notwithstanding the provisions of Laws | 0007| 1995, Chapter 218, Section 27, the authorization provided in Laws 1992, Chapter 113, Section | 0008| 20 is continued through fiscal year 1999. If the local government division of the department of | 0009| finance and administration has not certified the need for the issuance of the bonds by the end of | 0010| fiscal year 1998, the authorization provided in this section shall be void. Any unexpended or | 0011| unencumbered balance remaining at the end of fiscal year 1999 shall revert to the severance tax | 0012| bonding fund. | 0013| Section 3. EMERGENCY.--It is necessary for the public peace, health and safety | 0014| that this act take effect immediately. |
