0001| AN ACT | 0002| RELATING TO INDIAN CULTURE; ABOLISHING THE STATE AGENCY STATUS OF | 0003| THE INTERTRIBAL INDIAN CEREMONIAL ASSOCIATION; TRANSFERRING | 0004| PROPERTY AND PERSONNEL; AMENDING, REPEALING AND ENACTING SECTIONS | 0005| OF THE NMSA 1978. | 0006| | 0007| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0008| Section 1. A new section of the Tourism Department Act is enacted to read: | 0009| "SECRETARY--ADDITIONAL DUTIES--PROMOTION OF INDIAN ARTS, | 0010| CRAFTS AND CULTURE.--In addition to the secretary's responsibility for the overall | 0011| supervision of the department, the secretary shall: | 0012| A. encourage the preservation and development of Indian arts and crafts among | 0013| the Indian tribes and pueblos of the state; | 0014| B. encourage the preservation of traditional rites and ceremonials of Indian tribes | 0015| and pueblos to increase knowledge and appreciation of those arts, crafts, rites and ceremonials; | 0016| and | 0017| C. promote the intertribal Indian ceremonial association, incorporated, located in | 0018| Gallup." | 0019| Section 2. Section 13-1-99 NMSA 1978 (being Laws 1984, Chapter 65, Section 72, as | 0020| amended) is amended to read: | 0021| "13-1-99. EXCLUDED FROM CENTRAL PURCHASING THROUGH THE STATE | 0022| PURCHASING AGENT.--Excluded from the requirement of procurement through the state | 0023| purchasing agent but not from the requirements of the Procurement Code are the following: | 0024| A. procurement of professional services; | 0025| B. small purchases having a value not exceeding two hundred fifty dollars | 0001| ($250); | 0002| C. emergency procurement; | 0003| D. procurement of highway construction or reconstruction by the state highway | 0004| and transportation department; | 0005| E. procurement by the judicial branch of state government; | 0006| F. procurement by the legislative branch of state government; | 0007| G. procurement by the boards of regents of state educational institutions named | 0008| in Article 12, Section 11 of the constitution of New Mexico; | 0009| H. procurement of information processing resources procured through the | 0010| commission on information and communication management; | 0011| I. procurement by the state fair commission of tangible personal property, | 0012| services and construction under five thousand dollars ($5,000); | 0013| J. purchases from the instructional material fund; | 0014| K. procurement by all local public bodies; | 0015| L. procurement by regional education cooperatives; and | 0016| M. procurement by each state health care institution that provides direct patient | 0017| care and that is, or a part of which is, medicaid certified and participating in the New Mexico | 0018| medicaid program." | 0019| Section 3. TEMPORARY PROVISION--TRANSFER OF PERSONNEL, | 0020| APPROPRIATIONS AND ASSETS.--On the effective date of this act, all personnel, money, | 0021| appropriations, records, property, equipment and supplies belonging to the intertribal Indian | 0022| ceremonial association, a state agency, are transferred to the city of Gallup for the exclusive use | 0023| by the intertribal Indian ceremonial association, incorporated, a nonprofit corporation. | 0024| Section 4. REPEAL.--Sections 28-12-1 through 28-12-3 NMSA 1978 (being Laws | 0025| 1939, Chapter 42, Section 1 and Laws, 1967, Chapter 299, Sections 1 and 2) are repealed. | 0001| Section 5. EFFECTIVE DATE.--The effective date of the provisions of this act is | 0002| July 1, 1996. | 0003| |
