0001| AN ACT | 0002| AUTHORIZING A TRANSFER FROM THE GENERAL FUND OPERATING RESERVE | 0003| AND OTHER FUNDS TO MEET FISCAL YEAR 1995 OBLIGATIONS; DECLARING AN | 0004| EMERGENCY. | 0005| | 0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: Section 1. TRANSFER AUTHORITY--GENERAL FUND OPERATING RESERVE.-- | 0007| A. Upon a determination that fiscal year 1995 revenues | 0008| and transfers to the general fund, including the transfer | 0009| authorized by Laws 1995, Chapter 30, Section 8, are not | 0010| sufficient to meet fiscal year 1995 appropriations, and | 0011| contingent upon the enactment into law of Senate Bill 687 and | 0012| House Appropriations and Finance Committee Substitute for House | 0013| Bills 2, 3, 4, 5, 6 and 8 of the second session of the forty-second legislature, the governor, with state board of finance | 0014| approval, is authorized to make the following transfers in order | 0015| to meet that fiscal year's obligations: | 0016| (1) twenty-four million four hundred fifty | 0017| thousand dollars ($24,450,000) from the general fund operating | 0018| reserve; | 0019| (2) seven million five hundred thousand dollars | 0020| ($7,500,000) from the subsequent injury fund; and | 0021| (3) one million two hundred fifty thousand | 0022| dollars ($1,250,000) from the long-term lease guarantee fund. | 0023| | 0024| B. Upon a determination that fiscal year 1995 revenues | 0025| and transfers to the general fund, including the transfer | 0001| authorized by Laws 1995, Chapter 30, Section 8 and the transfers | 0002| authorized by Subsection A of this section, are not sufficient to | 0003| meet fiscal year 1995 appropriations and contingent upon the | 0004| enactment into law of Senate Bill 687 and House Appropriations | 0005| and Finance Committee Substitute for House Bills 2, 3, 4, 5, 6 | 0006| and 8 of the second session of the forty-second legislature, | 0007| after April 1, 1997 the governor, with state board of finance | 0008| approval, is authorized to transfer thirty-one million nine | 0009| hundred thousand dollars ($31,900,000) from the general fund | 0010| operating reserve to meet that fiscal year's obligations. | 0011| Section 2. EMERGENCY.--It is necessary for the public peace, health and safety | 0012| that this act take effect immediately. |
