0004| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0005|      Section 1.  REPEAL.--Sections 27-2A-1 through 27-2A-9 NMSA 1978 (being

0006|                                                               Laws 1994, Chapter 87, Sections 1 through 9), the Medicaid Estate Recovery Act, are
    |
0007|                                                               repealed when the federal government issues medicaid block grants.  Until the repeal, the
    |
0008|                                                               human services department shall define "homestead of modest value" to mean a property
    |
0009|                                                               that does not exceed one hundred thousand dollars ($100,000) for property tax purposes.
