0001| AN ACT | 0002| RELATING TO EDUCATION; AUTHORIZING TUITION SCHOLARSHIPS AT CERTAIN | 0003| POST-SECONDARY STATE EDUCATIONAL INSTITUTIONS; AMENDING AND | 0004| ENACTING CERTAIN SECTIONS OF THE NMSA 1978. | 0005| | 0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0007| Section 1. Section 21-1-2 NMSA 1978 (being Laws 1970, Chapter 9, Section 1, as | 0008| amended by Laws 1989, Chapter 44, Section 3 and by Laws 1989, Chapter 45, Section 3 and | 0009| also by Laws 1989, Chapter 68, Section 1) is amended to read: | 0010| "21-1-2. MATRICULATION AND TUITION FEES.-- | 0011| A. Except as otherwise provided in this section and in Section 21-1-4.3 NMSA | 0012| 1978, the boards of regents of the university of New Mexico, New Mexico state university, New | 0013| Mexico highlands university, western New Mexico university, eastern New Mexico university, | 0014| New Mexico military institute, New Mexico institute of mining and technology and New | 0015| Mexico junior college shall establish and charge matriculation fees and tuition fees as follows: | 0016| (1) each student shall be charged a matriculation fee of not less than five | 0017| dollars ($5.00) upon enrolling in each institution; | 0018| (2) each student who is a resident of New Mexico shall be charged a | 0019| tuition fee of not less than twenty dollars ($20.00) a year; | 0020| (3) each student who is not a resident of New Mexico shall be charged a | 0021| tuition fee of not less than fifty dollars ($50.00) a year; | 0022| (4) each student shall be charged a tuition fee of not less than ten dollars | 0023| ($10.00) for each summer session; and | 0024| (5) each student may be charged a tuition fee for extension courses. | 0025| B. Except as otherwise provided in this section and in Section 21-1-4.3 NMSA | 0001| 1978, the board of regents of northern New Mexico state school shall establish and charge each | 0002| student a matriculation fee and a tuition fee. | 0003| C. The board of regents of each institution may establish and grant gratis | 0004| scholarships to students who are residents of New Mexico in an amount not to exceed the | 0005| matriculation fee or tuition and fees, or both. Except as provided in Section 21-1-4.3 NMSA | 0006| 1978, the number of scholarships established and granted shall not exceed three percent of the | 0007| preceding fall semester enrollment in each institution and shall not be established and granted for | 0008| summer sessions. The president of each institution shall select and recommend to the board of | 0009| regents of his institution, as recipients of scholarships, students who possess good moral | 0010| character and satisfactory initiative, scholastic standing and personality. At least thirty-three and | 0011| one-third percent of the gratis scholarships established and granted by each board of regents each | 0012| year shall be granted on the basis of financial need. | 0013| D. The board of regents of each institution set out in this subsection may | 0014| establish and grant, in addition to those scholarships provided for in Subsection C of this section, | 0015| athletic scholarships for tuition and fees. In no event shall the board of regents of any institution | 0016| be allowed to award scholarships for tuition and fees for more than the number of athletic | 0017| scholarships set out in this subsection and in no event shall more than seventy-five percent of the | 0018| scholarships granted be for out-of-state residents: | 0019| (1) the board of regents of the university of New Mexico may grant up to | 0020| two hundred ninety-three athletic scholarships; | 0021| (2) the board of regents of New Mexico state university may grant up to | 0022| two hundred seventy athletic scholarships; | 0023| (3) the boards of regents of New Mexico highlands university, eastern | 0024| New Mexico university and western New Mexico university may each grant up to one hundred | 0025| forty athletic scholarships; and | 0001| (4) the board of regents of New Mexico junior college may grant up to | 0002| fifty-two athletic scholarships. | 0003| E. Notwithstanding the provisions of Subsection D of this section, in computing | 0004| tuition credits the commission on higher education shall accept the value of scholarships for | 0005| tuition and fees established by the boards of regents of the university of New Mexico, New | 0006| Mexico state university, eastern New Mexico university, western New Mexico university and | 0007| New Mexico highlands university for athletes for the seventy-eighth fiscal year and all fiscal | 0008| years thereafter. In no event shall the board of regents of any such institution be allowed to | 0009| establish scholarships for tuition and fees for more than the number of athletic scholarships per- | 0010| mitted that institution by regulations and bylaws of the national collegiate athletic association or | 0011| the national association of intercollegiate athletics of which that institution is a member. | 0012| F. Matriculation fees and tuition fees shall be fixed and made payable as directed | 0013| by the board of regents of each institution, collected by the officers of each institution and | 0014| accounted for as are other funds of the institutions. Matriculation fees shall be charged only | 0015| once for each institution in which a student enrolls." | 0016| Section 2. Section 21-1-4 NMSA 1978 (being Laws 1971, Chapter 235, Section 1) is | 0017| amended to read: | 0018| "21-1-4. TUITION CHARGES--DEFINITIONS.-- | 0019| A. Except as provided in Section 21-1-4.3 NMSA 1978, the state educational | 0020| institutions set forth in Article 12, Section 11 of the constitution of New Mexico shall charge | 0021| tuition, which is in addition to earmarked fees, at rates provided by law. | 0022| B. During the regular academic year, "full-time student" means a student who is | 0023| taking twelve or more credit-hours in one semester or quarter. Full-time students during the | 0024| academic year shall be charged tuition at rates provided by law. | 0025| C. During the summer session, "full-time student" means a student who is taking | 0001| at least a minimum number of credit-hours, which minimum is in the same proportion to twelve | 0002| credit-hours as the duration and normal credit-hour load of the summer session in the particular | 0003| institution is to the duration and normal credit-hour load of the institution's regular semester or | 0004| quarter. Full-time students in the summer session shall be charged tuition at resident and | 0005| nonresident rates in each institution, which rates shall be in the same proportion to the full-time | 0006| resident and nonresident rates of that institution for the regular semester or quarter as the | 0007| minimum number of credit-hours is to twelve hours. | 0008| D. "Part-time student" means a student who is taking less than the minimum | 0009| number of credit-hours in a semester, quarter or summer session than that required for full-time | 0010| student status. Part-time students shall be charged tuition at rates per semester- or quarter-credit-hour as provided by law. | 0011| E. The commission on higher education shall define resident and nonresident | 0012| students for the purpose of administering tuition charges in accordance with the constitution and | 0013| statutes of the state and after consultation with the appropriate officials of the institutions | 0014| concerned. Each institution shall use the uniform definitions so established in assessing and | 0015| collecting tuition charges from students." | 0016| Section 3. A new Section 21-1-4.3 NMSA 1978 is enacted to read: | 0017| "21-1-4.3. TUITION SCHOLARSHIPS AUTHORIZED--CERTAIN EDUCATIONAL | 0018| INSTITUTIONS.-- | 0019| A. To the extent that funds are made available by the legislature from the lottery | 0020| tuition fund, the boards of regents of New Mexico state university, New Mexico institute of | 0021| mining and technology, eastern New Mexico university, western New Mexico university, the | 0022| university of New Mexico, New Mexico highlands university and northern New Mexico state | 0023| school shall award tuition scholarships for qualified resident students attending their respective | 0024| institutions and branches of those institutions. | 0025| B. Except as authorized in Subsection C of this section, the tuition scholarships | 0001| authorized in this section shall apply only to full-time resident students who, immediately upon | 0002| completion of a high school curriculum at a public or accredited private New Mexico high | 0003| school, or upon receiving a graduate equivalent diploma, are accepted for entrance to and attend | 0004| one of the state educational institutions set forth in this section or one of the branches of those | 0005| institutions. Each tuition scholarship shall be awarded for up to four consecutive years | 0006| beginning the second semester of the recipient's first year of enrollment, provided that the | 0007| recipient has maintained residency in New Mexico and maintained a grade point average of 2.5 | 0008| or higher on a 4.0 scale during his first semester of full-time enrollment. | 0009| C. The tuition scholarships authorized in this section shall also apply to full-time | 0010| resident students who, immediately upon completion of a high school curriculum at a public or | 0011| accredited private New Mexico high school, or upon receiving a graduate equivalent diploma, | 0012| attend a two-year public post-secondary educational institution in New Mexico and who, upon | 0013| the completion of that curriculum or at the end of two years, whichever is sooner, transfer to one | 0014| of the post-secondary state educational institutions set forth in this section. Those students shall | 0015| be eligible for a tuition scholarship for two consecutive years, provided that those students | 0016| maintain residency in New Mexico, maintain a grade-point average of 2.5 or higher on a 4.0 | 0017| scale and attend the institution full time during the regular academic year. | 0018| D. The commission on higher education shall prepare guidelines setting forth | 0019| explicit student continuing eligibility criteria and guidelines for administration of the tuition | 0020| scholarship program. Guidelines shall be distributed to the board of regents of each institution | 0021| to enable a uniform availability of the resident student tuition scholarships." | 0022| Section 4. A new Section 21-1-4.4 NMSA 1978 is enacted to read: | 0023| "21-1-4.4. COMMISSION ON HIGHER EDUCATION--DETERMINATION OF | 0024| TUITION SCHOLARSHIPS--USE OF LOTTERY TUITION FUND.--Prior to June 1 of each | 0025| year, the commission on higher education shall determine the amount of money available for | 0001| tuition scholarships at state public post-secondary educational institutions. Based on the amount | 0002| appropriated by the legislature from the lottery tuition fund and on the projected enrollment at | 0003| all public post-secondary educational institutions, the commission on higher education shall | 0004| establish the percentage of tuition that shall be awarded for qualified resident students attending | 0005| New Mexico public post-secondary educational institutions. The percentage of tuition awarded | 0006| shall be the same for each institution, regardless of the actual cost of tuition at each institution." | 0007| Section 5. Section 21-13-10 NMSA 1978 (being Laws 1963, Chapter 17, Section 9, as | 0008| amended) is amended to read: | 0009| "21-13-10. BOARD DUTIES.-- | 0010| A. It shall be the duty of the community college board to determine financial and | 0011| educational policies of the community college. The community college board shall provide for | 0012| the management of the community college and execution of these policies by selecting a compe- | 0013| tent president for the | 0014| community college, and, upon the president's recommendation, the board shall employ other | 0015| administrative personnel, instructional staff or other personnel as may be needed for the opera- | 0016| tion, maintenance and administration of the community college. | 0017| B. The community college board shall have the power to fix tuition and fee rates | 0018| for resident and nonresident students of the district, to accept gifts, to accept federal aid, to | 0019| purchase, hold, sell and rent property and equipment and to promote the general welfare of the | 0020| institution for the best interest of educational service to the people of the community college | 0021| district. | 0022| C. To the extent that funds are made available by the legislature from the lottery | 0023| tuition fund, the community college board shall award tuition scholarships for qualified resident | 0024| students attending their respective institutions. | 0025| D. The tuition scholarships authorized in this section shall apply only to full-time | 0001| resident students who, immediately upon completion of a high school curriculum at a public or | 0002| accredited private New Mexico high school, or upon receiving a graduate equivalent diploma, | 0003| are accepted for entrance to and attend a community college. Each tuition scholarship shall be | 0004| awarded for up to two consecutive years beginning the second semester of the recipient's first | 0005| year of enrollment, provided that the recipient has maintained residency in New Mexico and | 0006| maintained a grade-point average of 2.5 or higher on a 4.0 scale during his first semester of full-time enrollment. | 0007| E. The commission on higher education shall prepare guidelines setting forth | 0008| explicit student continuing eligibility criteria and guidelines for administration of the tuition | 0009| scholarship program. Guidelines shall be distributed to community college boards to enable a | 0010| uniform availability of the resident student tuition scholarship." | 0011| Section 6. A new section of the Technical and Vocational Institute Act is enacted to | 0012| read: | 0013| "TUITION SCHOLARSHIPS AUTHORIZED.-- | 0014| A. To the extent that funds are made available by the legislature from the lottery | 0015| tuition fund, the board of a technical and vocational institute shall award tuition scholarships for | 0016| qualified resident students attending a technical and vocational institute. | 0017| B. The tuition scholarships authorized in this section shall apply only to full-time | 0018| resident students who, immediately upon completion of a high school curriculum at a public or | 0019| accredited private New Mexico high school, or upon receiving a graduate equivalent diploma, | 0020| are accepted for entrance to and attend a technical and vocational institute. Each tuition | 0021| scholarship shall be awarded for up to two consecutive years beginning the second semester of | 0022| the recipient's first year of enrollment, provided that the recipient has maintained residency in | 0023| New Mexico and maintained a grade-point average of 2.5 or higher on a 4.0 scale during his first | 0024| semester of full-time enrollment. | 0025| C. The commission on higher education shall prepare guidelines setting forth | 0001| explicit student continuing eligibility criteria and guidelines for administration of the tuition | 0002| scholarship program. Guidelines shall be distributed to the boards of technical and vocational | 0003| institutes to enable a uniform availability of the resident student tuition scholarships." | 0004| Section 7. A new section of Chapter 21, Article 17 NMSA 1978 is enacted to read: | 0005| "TUITION SCHOLARSHIPS AUTHORIZED.-- | 0006| A. To the extent that funds are made available by the legislature from the lottery | 0007| tuition fund, the board of an area vocational school shall award tuition scholarships for qualified | 0008| resident students attending its area vocational school. | 0009| B. The tuition scholarships authorized in this section shall apply only to full-time | 0010| resident students who, immediately upon completion of a high school curriculum at a public or | 0011| accredited private New Mexico high school, or upon receiving a graduate equivalent diploma, | 0012| are accepted for entrance to and attend an area vocational school. Each tuition scholarship shall | 0013| be awarded for up to two consecutive years beginning the second semester of the recipient's first | 0014| year of enrollment, provided that the recipient has maintained residency in New Mexico and | 0015| maintained a grade-point average of 2.5 or higher on a 4.0 scale during his first semester of full-time enrollment. | 0016| C. The commission on higher education shall prepare guidelines setting | 0017| forth explicit student qualification criteria and guidelines for administration of the tuition | 0018| scholarship program. Guidelines shall be distributed to the boards of all area vocational | 0019| schools to enable a uniform availability of the resident student tuition scholarships." | 0020| |
