0001| A JOINT RESOLUTION | 0002| AUTHORIZING THE TRANSFER OF OWNERSHIP OF THE AZTEC WELCOME CENTER TO THE | 0003| CITY OF AZTEC. | 0004| | 0005| WHEREAS, in 1990 the New Mexico legislature appropriated funds for | 0006| the construction of the welcome center in Aztec; and | 0007| WHEREAS, since its construction, the center has operated to | 0008| provide information to both residents and tourists in the four corners | 0009| area; and | 0010| WHEREAS, the tourism department has determined that it is unable | 0011| to adequately operate and maintain the center and that the local | 0012| government could adequately and appropriately perform that function | 0013| instead; and | 0014| WHEREAS, Section 13-6-2 NMSA 1978 authorizes the sale and | 0015| disposition of real property belonging to state agencies; and | 0016| WHEREAS, in 1974, the New Mexico supreme court determined that the | 0017| provisions of the constitution of New Mexico prohibiting donations or | 0018| gifts to public corporations do not apply to legislatively sanctioned | 0019| transfers by the state or one of its agencies to another such agency; | 0020| and | 0021| WHEREAS, it is in the public interest that the legislature | 0022| authorize and sanction the sale of the Aztec welcome center to the city | 0023| of Aztec for minimal consideration so that the city may continue to | 0024| operate the facility in the four corners area; | 0025| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF | 0001| NEW MEXICO that the legislature authorize and sanction the proposed sale | 0002| of the Aztec welcome center to the city of Aztec for minimal | 0003| consideration; and | 0004| BE IT FURTHER RESOLVED that copies of this resolution be | 0005| transmitted to the tourism department, the general services department | 0006| and the city of Aztec. |
