0002| APPROVING AND RATIFYING THE TRANSFER OF REAL PROPERTY BY THE GENERAL
    |
0003| SERVICES DEPARTMENT TO THE STATE ARMORY BOARD.
    |

    |
0005|      WHEREAS, the property control division of the general services
    |
0006| department has control over certain state buildings and lands; and
    |
0007|      WHEREAS, the property control division of the general services
    |
0008| department has authority to sell or trade state buildings and real
    |
0009| property under its control in accordance with Section 13-6-3 NMSA 1978;
    |
0010| and
    |
0011|      WHEREAS, the property of approximately seven and one-half acres in
    |
0012| the city of Santa Fe known as 1050 Old Pecos trail is under the
    |
0013| jurisdiction of the property control division of the general services
    |
0014| department; and
    |
0015|      WHEREAS, that property is the former New Mexico national guard
    |
0016| headquarters and training center; and
    |
0017|      WHEREAS, after construction of a new national guard armory on
    |
0018| Cerrillos road in the city of Santa Fe, the state armory board
    |
0019| transferred title to the property to the general services department;
    |
0020| and
    |
0021|      WHEREAS, the New Mexico national guard 200th coast artillery
    |
0022| regiment trained at the former national guard armory site on Old Pecos
    |
0023| trail; and
    |
0024|      WHEREAS, the 200th coast artillery regiment was the primary
    |
0025| military unit in the "Bataan death march"; and
    |
0001|      WHEREAS, less than half of the one thousand eight hundred New
    |
0002| Mexicans deployed to the Philippines in 1942 returned from the "Bataan
    |
0003| death march"; and
    |
0004|      WHEREAS, the New Mexico house of representatives passed House
    |
0005| Memorial 76 in 1994 supporting the relocation of the Bataan memorial
    |
0006| military museum to that site; and
    |
0007|      WHEREAS, the Bataan memorial military museum was relocated to the
    |
0008| lobby of the theater at 1050 Old Pecos trail in August 1994; and
    |
0009|      WHEREAS, there is significant interest by the national association
    |
0010| of American prisoners of war and others to locate a world-class national
    |
0011| Bataan memorial museum at the site of the former New Mexico national
    |
0012| guard headquarters and training center on Old Pecos trail; and
    |
0013|      WHEREAS, the Bataan memorial military museum and the New Mexico
    |
0014| national guard historical foundation have requested that the general
    |
0015| services department return the property to the state armory board; and
    |
0016|      WHEREAS, the armory for the arts theater, the children's museum
    |
0017| and the center for contemporary arts occupy facilities at 1050 Old Pecos
    |
0018| trail; and
    |
0019|      WHEREAS, the Bataan memorial military museum and the New Mexico
    |
0020| national guard historical foundation have expressed interest in
    |
0021| continuing the current activities of the armory for the arts theater,
    |
0022| the children's museum and the center for contemporary arts located on
    |
0023| the property until plans for a national museum are further developed and
    |
0024| until appropriate space can be found to relocate those functions; and
    |
0025|      WHEREAS, the value of the property exceeds one hundred thousand
    |
0001| dollars ($100,000);
    |
0002|      NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF
    |
0003| NEW MEXICO that the general services department be authorized to
    |
0004| transfer to the state armory board the real property and improvements
    |
0005| located at 1050 Old Pecos trail in Santa Fe; and
    |
0006|      BE IT FURTHER RESOLVED that the secretary of general services be
    |
0007| empowered to take all actions necessary or expedient to accomplish the
    |
0008| transfer of the real property to the state armory board; and
    |
0009|      BE IT FURTHER RESOLVED that any leases or other written agreements
    |
0010| between the general services department and other entities at 1050 Old
    |
0011| Pecos trail will transfer to and be binding upon the state armory board;
    |
0012| and
    |
0013|      BE IT FURTHER RESOLVED that, pursuant to Section 13-6-3 NMSA 1978,
    |
0014| the legislature approve and ratify the transfer of the real property
    |
0015| described herein by the general services department to the state armory
    |
0016| board; and
    |
0017|      BE IT FURTHER RESOLVED that a copy of this resolution be
    |
0018| transmitted to the general services department, the state armory board
    |
0019| and the Bataan memorial military museum.
