0001| AN ACT | 0002| CREATING THE LEGISLATIVE HEALTH CARE TASK FORCE. | 0003| | 0004| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0005| Section 1. HEALTH CARE TASK FORCE CREATED--TERMINATION.--There is | 0006| created a joint interim legislative task force, which shall be known as | 0007| the "health care task force". The task force shall function from the | 0008| date of its appointment until the first day of December prior to the | 0009| first session of the forty-fourth legislature. | 0010| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.-- | 0011| A. The health care task force shall be composed of twelve | 0012| voting legislative members and ten voting nonlegislative members. The | 0013| speaker of the house of representatives shall appoint six members of the | 0014| house of representatives, one of whom shall be the chairman or vice | 0015| chairman of the legislative health and human services committee, and the | 0016| president pro tempore of the senate shall appoint six members of the | 0017| senate, one of whom shall be the chairman or vice chairman of the | 0018| legislative health and human services committee. The speaker of the | 0019| house of representatives and the president pro tempore of the senate | 0020| shall designate the chairman and vice chairman of the task force. | 0021| B. Members of the health care task force shall be appointed | 0022| from each house to give the two major political parties in each house | 0023| the same proportional representation on the task force as prevails in | 0024| each house; however, in no event shall either party have less than one | 0025| member from each house on the task force. Vacancies on the task force | 0001| shall be filled by appointment in the same manner as the original | 0002| appointments. | 0003| C. No action shall be taken by the health care task force if | 0004| a majority of the total membership from either house on the health care | 0005| task force rejects such action. | 0006| D. The nonlegislative members of the health care task force | 0007| who do not serve ex officio shall be appointed by the speaker of the | 0008| house of representatives and the president pro tempore of the senate as | 0009| follows: | 0010| (1) two public members representing the business | 0011| community, one representing small employers and one representing large | 0012| employers; | 0013| (2) a public member who is an attorney with expertise | 0014| in the area of health care; | 0015| (3) a health care reform advocate; and | 0016| (4) two members of a Native American nation, tribe or | 0017| pueblo of this state. | 0018| E. The additional nonlegislative members shall be: | 0019| (1) the secretary of human services or the secretary's | 0020| designee; | 0021| (2) the secretary of health or the secretary's | 0022| designee; | 0023| (3) a representative of the New Mexico health policy | 0024| commission; and | 0025| (4) the superintendent of insurance or the | 0001| superintendent's designee. | 0002| F. Members may vote on all matters before the health care | 0003| task force, but only voting legislative members may vote on proposed | 0004| legislation. | 0005| G. The public members shall be paid per diem and mileage in | 0006| accordance with the provisions of the Per Diem and Mileage Act. | 0007| H. Additionally, the chairman and vice chairman, with | 0008| approval of the speaker of the house of representatives and the | 0009| president pro tempore of the senate, may appoint an advisory group to | 0010| the task force that includes representatives of the aging population | 0011| with expertise in long-term care, health care providers, the university | 0012| of New Mexico health sciences center, the New Mexico medical society, | 0013| the New Mexico hospital and health systems association, the nursing | 0014| profession, the association of counties, the municipal league, | 0015| community-based providers, the insurance industry, consumers, employers, | 0016| the workers' compensation administration, the retiree health care | 0017| authority, the public school insurance authority and the risk management | 0018| division of the general services department. | 0019| Section 3. DUTIES.--After the health care task force members are | 0020| appointed, the task force shall hold one organizational meeting to | 0021| develop a work plan and budget for the ensuing interim. The work plan | 0022| and budget shall be submitted to the legislative council for approval. | 0023| Upon approval of the work plan and budget by the legislative council, | 0024| the task force shall review health care reform issues, including making | 0025| efforts to: | 0001| A. facilitate an ongoing partnership between the legislative | 0002| and executive branches and bring together various groups working on | 0003| health care reforms to: | 0004| (1) improve the health status of New Mexicans; | 0005| (2) enhance access to medical services with a | 0006| commitment to protecting vulnerable populations; | 0007| (3) strengthen the currently existing local health | 0008| care infrastructure, both private and public, to assure appropriate | 0009| access to needed services; | 0010| (4) protect the quality of health care from erosion | 0011| for cost savings; and | 0012| (5) improve the efficiency of health care delivery; | 0013| B. consider and investigate the supply and distribution of | 0014| the state's health professional work force to determine what providers | 0015| and infrastructure are necessary for health care delivery, including the | 0016| development of priorities for geographic access of health care service | 0017| in the state to revise the composition of health professionals to meet | 0018| the health care service needs of the state; | 0019| C. investigate legal and regulatory issues affecting the | 0020| health care industry, including the use of integrated health plans for | 0021| the medicaid managed care program; | 0022| D. oversee developments to the health information system, | 0023| including the efforts of the health information alliance, the initiation | 0024| of confidential health information and patient privacy legislation and | 0025| consumer report cards; | 0001| E. investigate the role of the university of New Mexico | 0002| health sciences center regarding its service mission as a vital | 0003| education institution in the state and its role in filling the gaps of | 0004| health care service where the private sector is unable to deliver | 0005| service; | 0006| F. create and sustain an ongoing dialogue with | 0007| representatives from New Mexico Indian nations, tribes and pueblos to | 0008| discuss health care issues related to Native American people, the role | 0009| of the Indian health service as a provider of health care services and | 0010| the integration of the medicaid managed care program with the Indian | 0011| health service and Indian communities; | 0012| G. provide legislative oversight on the implementation of | 0013| health care reform measures, health care delivery and payment proposals | 0014| and changes in federal and state law that impact health care reform | 0015| programs that become law; and | 0016| H. recommend legislation or changes if any are found to be | 0017| necessary to the first and second sessions of the forty-third | 0018| legislature and to the first session of the forty-fourth legislature. | 0019| Section 4. SUBCOMMITTEES.--Subcommittees shall be created only by | 0020| majority vote of all members appointed to the health care task force and | 0021| with the prior approval of the legislative council. A subcommittee | 0022| shall be composed of at least one member from the senate and one member | 0023| from the house of representatives, and at least one member of the | 0024| minority party shall be a member of the subcommittee. All meetings and | 0025| expenditures of a subcommittee shall be approved by the full task force | 0001| in advance of such meeting or expenditure, and the approval shall be | 0002| shown in the minutes of the task force. | 0003| Section 5. REPORT.--The health care task force shall make a | 0004| report of its findings and recommendations for the consideration of the | 0005| first and second sessions of the forty-third legislature and the first | 0006| session of the forty-fourth legislature. The reports and suggested | 0007| legislation shall be made available to the legislative council, the | 0008| legislative finance committee, the legislative health and human services | 0009| committee and the New Mexico health policy commission on or before | 0010| November 30 preceding each session. | 0011| Section 6. STAFF.--The staff for the health care task force shall | 0012| be provided by the legislative council service, and the staff of the New | 0013| Mexico health policy commission shall assist the health care task force | 0014| as requested. The legislative council service at the direction of the | 0015| task force may hire additional staff as necessary and may contract with | 0016| experts, including economists, actuaries and the bureau of business and | 0017| economic research at the university of New Mexico, to assist the task | 0018| force in carrying out its tasks. | 0019| | 0020| | 0021| HB | 0022| 217 | 0023| Page  |
