0001| AN ACT | 0002| RELATING TO STATE AGENCIES; PROVIDING SUNSETTING PROVISIONS FOR CERTAIN | 0003| ACTS AND BOARDS OF VARIOUS TRADES AND PROFESSIONS; AMENDING AND | 0004| REPEALING VARIOUS SECTIONS OF THE NMSA 1978 THAT RELATE TO REGULATION | 0005| AND LICENSURE; DECLARING AN EMERGENCY. | 0006| | 0007| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0008| Section 1. Section 61-7A-5 NMSA 1978 (being Laws 1989, Chapter | 0009| 387, Section 5) is amended to read: | 0010| "61-7A-5. BOARD CREATED.-- | 0011| A. There is created the "nutrition and dietetics practice | 0012| board", administratively attached to the regulation and licensing de- | 0013| partment. The board shall consist of five members who are New Mexico | 0014| residents and who are appointed by the governor for staggered three-year | 0015| terms. Three members shall be licensed dietitians or nutritionists with | 0016| at least three years of nutrition or dietetics practice in New Mexico | 0017| and two members shall represent the public. There shall be at least one | 0018| dietitian and at least one nutritionist on the board at all times. The | 0019| public members shall not have been licensed as a dietitian or nutri- | 0020| tionist or have any financial interest, direct or indirect, in the | 0021| professions regulated. | 0022| B. Each member shall hold office until the expiration of the | 0023| term for which appointed or until a successor has been appointed. | 0024| Vacancies shall be filled for the balance of the unexpired term within | 0025| ninety days of the vacancy by appointment by the governor. | 0001| C. No board member shall serve more than two full terms. | 0002| D. The board shall elect annually a chairman and such other | 0003| officers as it deems necessary. The board shall meet as often as neces- | 0004| sary for the conduct of business, but no less than twice a year. Meet- | 0005| ings shall be called by the chairman or upon the written request of two | 0006| or more members of the board. Three members, at least two of whom are | 0007| professional members and at least one of whom is a public member, shall | 0008| constitute a quorum. Any member failing to attend, after proper notice, | 0009| three consecutive meetings shall automatically be removed as a board | 0010| member. | 0011| E. The members of the board shall be reimbursed as provided | 0012| for nonsalaried public officers in the Per Diem and Mileage Act and | 0013| shall receive no other compensation, perquisite or allowance." | 0014| Section 2. Section 61-7A-6 NMSA 1978 (being Laws 1989, Chapter | 0015| 387, Section 6) is amended to read: | 0016| "61-7A-6. BOARD--DUTIES.-- | 0017| A. The board shall: | 0018| (1) develop and administer an appropriate examination | 0019| for qualified applicants; | 0020| (2) evaluate the qualifications of applicants for li- | 0021| censure under the Nutrition and Dietetics Practice Act; | 0022| (3) issue licenses to applicants who meet the require- | 0023| ments of the Nutrition and Dietetics Practice Act; | 0024| (4) investigate persons engaging in practices that may | 0025| violate the provisions of the Nutrition and Dietetics Practice Act; | 0001| (5) revoke, suspend or deny a license in accordance | 0002| with the provisions of the Uniform Licensing Act; | 0003| (6) adopt an annual budget; | 0004| (7) adopt a code of ethics; and | 0005| (8) adopt in accordance with the Uniform Licensing Act | 0006| and file in accordance with the State Rules Act rules and regulations | 0007| necessary to carry out the provisions of the Nutrition and Dietetics | 0008| Practice Act; provided, no rule or regulation may be adopted, amended or | 0009| repealed except by a vote of three-fifths of the board members. | 0010| B. The board may contract with the regulation and licensing | 0011| department for office space and administrative support." | 0012| Section 3. Section 61-7A-7 NMSA 1978 (being Laws 1989, Chapter | 0013| 387, Section 7) is amended to read: | 0014| "61-7A-7. LICENSURE--REQUIREMENTS.-- | 0015| A. The board shall issue a license as a dietitian to any | 0016| person who files a completed application, pays all required fees and | 0017| certifies and furnishes evidence satisfactory to the board that the | 0018| applicant has a valid current registration with the commission that | 0019| gives the applicant the right to use the term "registered dietitian" or | 0020| "R.D.". | 0021| B. The board shall issue a license as a nutritionist to any | 0022| person who files a completed application, pays all required fees and | 0023| certifies and furnishes evidence satisfactory to the board that the | 0024| applicant: | 0025| (1) has received a master's degree or doctorate in hu- | 0001| man nutrition, nutrition education, foods and nutrition or public health | 0002| nutrition from a college or university accredited by a member of the | 0003| council on post-secondary accreditation; or | 0004| (2) maintains membership in one of the following orga- | 0005| nizations: | 0006| (a) the American institute of nutrition; | 0007| (b) the American society for clinical nutrition; | 0008| or | 0009| (c) the American board of nutrition; and | 0010| (3) has successfully completed any training or educa- | 0011| tional programs and other requirements set out in the rules and | 0012| regulations adopted pursuant to the Nutrition and Dietetics Practice | 0013| Act. | 0014| C. Notwithstanding the provisions of Subsections A and B of | 0015| this section, the board shall issue a license to an applicant who pays | 0016| all required fees and who successfully passes a state examination, as | 0017| established in Subsection A of Section 61-7A-6 NMSA 1978. | 0018| D. The board shall issue a license as a nutrition associate | 0019| to any person who files a completed application, pays all required fees | 0020| and certifies and furnishes evidence satisfactory to the board that the | 0021| applicant: | 0022| (1) has received a baccalaureate or higher degree from | 0023| a college or university accredited by a member of the council on | 0024| post-secondary accreditation and fulfilled minimum academic requirements | 0025| in the field of dietetics and related disciplines as approved by the as- | 0001| sociation; and | 0002| (2) works under the supervision of a dietitian or nu- | 0003| tritionist. Such supervision shall include a minimum of four hours | 0004| onsite supervision per month plus phone consultation as needed. | 0005| E. A valid license issued pursuant to the Nutrition and | 0006| Dietetics Practice Act shall be displayed at the licensee's place of | 0007| employment. | 0008| F. Licenses, including initial licenses, shall be issued for | 0009| a period of one year." | 0010| Section 4. Section 61-7A-15 NMSA 1978 (being Laws 1989, Chapter | 0011| 387, Section 15) is amended to read: | 0012| "61-7A-15. TERMINATION OF AGENCY LIFE--DELAYED REPEAL.--The board | 0013| is terminated on July 1, 1997 pursuant to the Sunset Act. The board | 0014| shall continue to operate according to the provisions of the Nutrition | 0015| and Dietetics Practice Act until July 1, 1998. Effective July 1, 1998, | 0016| the Nutrition and Dietetics Practice Act is repealed." | 0017| Section 5. Section 61-9-3 NMSA 1978 (being Laws 1963, Chapter 92, | 0018| Section 3, as amended) is amended to read: | 0019| "61-9-3. DEFINITIONS.--As used in the Professional Psychologist | 0020| Act: | 0021| A. "board" means the New Mexico state board of psychologist | 0022| examiners; | 0023| B. "department" means the regulation and licensing | 0024| department or the division of the department designated to administer | 0025| the provisions of the Professional Psychologist Act; | 0001| C. "person" includes an individual, firm, partnership, as- | 0002| sociation or corporation; | 0003| D. "psychologist" means any person who engages in the | 0004| practice of psychology or holds himself out to the public by any title | 0005| or description of services representing himself as a psychologist, which | 0006| incorporates the words "psychological", "psychologist", "psychology", or | 0007| when a person describes himself as above and, under such title or | 0008| description, offers to render or renders services involving the | 0009| application of principles, methods and procedures of the science and | 0010| profession of psychology to persons for compensation or other personal | 0011| gain; | 0012| E. "practice of psychology" means the observation, descrip- | 0013| tion, evaluation, interpretation and modification of human behavior by | 0014| the application of psychological principles, methods and procedures for | 0015| the purpose of preventing or eliminating symptomatic, maladaptive or | 0016| undesired behavior and of enhancing interpersonal relationships, work | 0017| and life adjustment, personal effectiveness, behavioral health and | 0018| mental health, and further means the rendering of such psychological | 0019| services to individuals, families or groups regardless of whether | 0020| payment is received for services rendered. The practice of psychology | 0021| includes, but is not limited to, psychological testing or neuropsycho- | 0022| logical testing and the evaluation or assessment of personal character- | 0023| istics such as intelligence, personality, abilities, interests, apti- | 0024| tudes and neuropsychological functioning; counseling, psychoanalysis, | 0025| psychotherapy, hypnosis, biofeedback, behavior analysis and therapy; | 0001| diagnosis and treatment of any mental and emotional disorder or dis- | 0002| ability, alcoholism and substance abuse, disorders of habit or conduct | 0003| and the psychological aspects of physical illness, accident, injury and | 0004| disability; and psychoeducational evaluation, therapy, remediation and | 0005| consultation; and | 0006| F. "school" or "college" means any university or other in- | 0007| stitution of higher learning offering a full-time graduate course of | 0008| study in psychology, which is regionally accredited or whose accredita- | 0009| tion as an institution of higher learning is recognized by the state | 0010| department of public education or is satisfactory to the board." | 0011| Section 6. Section 61-9-5 NMSA 1978 (being Laws 1989, Chapter 41, | 0012| Section 5, as amended) is amended to read: | 0013| "6l-9-5. STATE BOARD OF EXAMINERS--PSYCHOLOGY FUND.-- | 0014| A. There is created a "New Mexico state board of | 0015| psychologist examiners" consisting of eight members appointed by the | 0016| governor who are residents of New Mexico and who shall serve for | 0017| three-year staggered terms. No board member shall serve more than two | 0018| terms. The members shall be appointed as follows: | 0019| (1) four members shall be professional members who are | 0020| licensed under the Professional Psychologist Act as psychologists and | 0021| may be appointed from a list of names nominated by the New Mexico | 0022| psychological association, the state psychologist association and the | 0023| New Mexico school psychologist association; | 0024| (2) one member shall be licensed under the | 0025| Professional Psychologist Act as a psychologist or psychologist | 0001| associate; and | 0002| (3) three members shall be public members who are | 0003| laymen and have no significant financial interest, direct or indirect, | 0004| in the practice of psychology. | 0005| B. Each member shall hold office until the expiration of his | 0006| appointed term or until a successor is duly appointed. When the term of | 0007| each member ends, the governor shall appoint his successor for a term of | 0008| three years. Any vacancy occurring in the board membership other than | 0009| by expiration of term shall be filled by the governor by appointment for | 0010| the unexpired term of the member. The governor may remove any board | 0011| member for misconduct, incompetency or neglect of duty. Any member | 0012| failing to attend, after proper notice, three consecutive meetings shall | 0013| automatically be removed as a board member. | 0014| C. All money received by the board shall be credited to the | 0015| "psychology fund", and a receipt for the same shall be kept by the | 0016| secretary-treasurer of the board. The members of the board may be | 0017| reimbursed as provided in the Per Diem and Mileage Act, but shall | 0018| receive no other compensation, perquisite or allowance. The | 0019| secretary-treasurer may receive such salary as the board determines. | 0020| The sums, together with all other incidental expenses of the board, | 0021| shall be approved by the board and sent to the auditor for payment." | 0022| Section 7. Section 61-9-6 NMSA 1978 (being Laws 1963, Chapter 92, | 0023| Section 5, as amended) is amended to read: | 0024| "61-9-6. BOARD--MEETING--POWERS.-- | 0025| A. The board shall, annually in the month of July, hold a | 0001| meeting and elect from its membership a chairman and vice chairman. The | 0002| board shall meet at such other times as it deems necessary or advisable | 0003| or as deemed necessary and advisable by the chairman or a majority of | 0004| its members or the governor. Reasonable notice of all meetings shall be | 0005| given in the manner prescribed by the board. A majority of the board | 0006| constitutes a quorum at any meeting or hearing. | 0007| B. The board is authorized to: | 0008| (1) adopt and from time to time revise such rules and | 0009| regulations not inconsistent with the law as may be necessary to carry | 0010| into effect the provisions of the Professional Psychologist Act. Such | 0011| rules and regulations shall include but not be limited to a code of | 0012| conduct for psychologists and psychologist associates in the state; | 0013| (2) employ, within the funds available, a secretary | 0014| and other personnel necessary for the proper performance of its work | 0015| under the Professional Psychologist Act; | 0016| (3) adopt a seal, and the secretary shall have the | 0017| care and custody of the seal; | 0018| (4) examine for, approve, deny, revoke, suspend and | 0019| renew the licensure of psychologist and psychologist associate appli- | 0020| cants as provided in the Professional Psychologist Act; | 0021| (5) conduct hearings upon complaints concerning the | 0022| disciplining of a psychologist or psychologist associate; | 0023| (6) enforce all provisions of the Professional | 0024| Psychologist Act and all rules and regulations adopted under that act; | 0025| and | 0001| (7) cause the prosecution and enjoinder of all persons | 0002| violating the Professional Psychologist Act and incur necessary expenses | 0003| therefor. | 0004| C. Within sixty days after the close of each fiscal year, | 0005| the board shall submit a written or printed report, reviewed and signed | 0006| by the board members, to the governor concerning the work of the board | 0007| during the preceding fiscal year. The report shall include the names of | 0008| all psychologists and psychologist associates to whom licenses have been | 0009| granted; any cases heard and decisions rendered in relation to the work | 0010| of the board; the recommendations of the board as to future policies; | 0011| the names, remuneration and duties of any employees of the board; and an | 0012| account of all money received and expended by the board." | 0013| Section 8. Section 61-9-19 NMSA 1978 (being Laws 1978, Chapter | 0014| 188, Section 2, as amended) is amended to read: | 0015| "61-9-19. TERMINATION OF AGENCY LIFE--DELAYED REPEAL.--The New | 0016| Mexico state board of psychologist examiners is terminated on July 1, | 0017| 1997 pursuant to the Sunset Act. The board shall continue to operate | 0018| according to the provisions of Chapter 61, Article 9 NMSA 1978 until | 0019| July 1, 1998. Effective July 1, 1998, Article 9 of Chapter 61 NMSA 1978 | 0020| is repealed." | 0021| Section 9. Section 61-12B-5 NMSA 1978 (being Laws 1984, Chapter | 0022| 103, Section 5, as amended) is amended to read: | 0023| "61-12B-5. ADVISORY BOARD CREATED.-- | 0024| A. The superintendent shall appoint an "advisory board of | 0025| respiratory care practitioners" consisting of five members as follows: | 0001| (1) one physician licensed in New Mexico who is knowl- | 0002| edgeable in respiratory care; | 0003| (2) two respiratory care practitioners; and | 0004| (3) two public members who are residents of New Mexico. | 0005| The public members shall not have been licensed as respiratory care | 0006| practitioners nor shall they have any financial interest, direct or in- | 0007| direct, in the occupation regulated. | 0008| B. Each member shall serve no more than two three-year | 0009| terms. | 0010| C. The members of the board shall receive per diem and mile- | 0011| age as provided for nonsalaried public officers in the Per Diem and | 0012| Mileage Act and shall receive no other compensation, perquisite or al- | 0013| lowance in connection with the discharge of their duties as board mem- | 0014| bers. Three members, including at least one public member, constitute a | 0015| quorum. | 0016| D. Any member failing, after proper notice, to attend any | 0017| three consecutive meetings of the board without a reasonable excuse | 0018| shall be automatically removed from the board." | 0019| Section 10. Section 61-12B-9 NMSA 1978 (being Laws 1984, Chapter | 0020| 103, Section 9, as amended) is amended to read: | 0021| "61-12B-9. OTHER LICENSING PROVISIONS.-- | 0022| A. The department, in consultation with the board, shall | 0023| adopt rules and regulations for mandatory continuing education | 0024| requirements that shall be completed as a condition for renewal of any | 0025| license issued pursuant to provisions of the Respiratory Care Act. | 0001| B. The department, in consultation with the board, may adopt | 0002| rules and regulations for issuance of temporary permits for students and | 0003| graduates of approved training programs to practice limited respiratory | 0004| care under the direct supervision of a licensed respiratory care | 0005| practitioner or physician. Rules and regulations shall be adopted | 0006| defining, for the purposes of the Respiratory Care Act, the terms | 0007| "students" and "direct supervision". | 0008| C. The license issued by the department shall describe the | 0009| licensed person as a "respiratory care practitioner licensed by the New | 0010| Mexico regulation and licensing department" and shall be displayed in | 0011| the licensee's place of business. | 0012| D. Unless licensed as a respiratory care practitioner | 0013| pursuant to provisions of the Respiratory Care Act, no person shall use | 0014| the title "respiratory care practitioner", the abbreviation "R.C.P." or | 0015| any other title or abbreviation to indicate that the person is a | 0016| licensed respiratory care practitioner. | 0017| E. A copy of the valid license or temporary permit issued | 0018| pursuant to the Respiratory Care Act shall be displayed at the | 0019| respiratory care practitioner's place of employment. | 0020| F. Licenses, including initial licenses, shall be issued for | 0021| a period of two years." | 0022| Section 11. Section 61-12B-16 NMSA 1978 (being Laws 1984, Chapter | 0023| 103, Section 17, as amended) is amended to read: | 0024| "61-12B-16. TERMINATION OF BOARD--DELAYED REPEAL.--The board is | 0025| terminated on July 1, 1997 pursuant to the Sunset Act. The board shall | 0001| continue to operate until July 1, 1998. Effective July 1, 1998, the | 0002| Respiratory Care Act is repealed." | 0003| Section 12. Section 61-14B-17 NMSA 1978 (being Laws 1990, Chapter | 0004| 16, Section 4) is amended to read: | 0005| "61-14B-17. TERMINATION OF AGENCY LIFE--DELAYED REPEAL.--The | 0006| speech-language pathology and audiology advisory board is terminated on | 0007| July 1, 1997 pursuant to the Sunset Act. The board shall continue to | 0008| operate according to the provisions of Chapter 61, Article 14B NMSA 1978 | 0009| until July 1, 1998. Effective July 1, 1998, Article 14B of Chapter 61 | 0010| NMSA 1978 is repealed." | 0011| Section 13. Section 61-24A-21 NMSA 1978 (being Laws 1991, Chapter | 0012| 46, Section 12) is amended to read: | 0013| "61-24A-21. TERMINATION OF AGENCY LIFE--DELAYED REPEAL.--The | 0014| hearing aid advisory board is terminated on July 1, 1997. The board | 0015| shall continue to operate according to the provisions of Chapter 61, | 0016| Article 24A NMSA 1978 until July 1, 1998. Effective July 1, 1998, | 0017| Article 24A of Chapter 61 NMSA 1978 is repealed." | 0018| Section 14. Section 61-31-6 NMSA 1978 (being Laws 1989, Chapter | 0019| 51, Section 6) is amended to read: | 0020| "61-31-6. SCOPE OF PRACTICE.-- | 0021| A. For the purposes of the Social Work Practice Act, a per- | 0022| son is practicing social work if he advertises, offers himself to prac- | 0023| tice, is employed in a position described as social work or holds out to | 0024| the public or represents in any manner that he is licensed to practice | 0025| social work in this state. | 0001| B. Social work practice means a professional service and | 0002| emphasizes the use of specialized knowledge of social resources, social | 0003| systems and human capabilities to effect change in human behavior, emo- | 0004| tional responses and social conditions. Services may be rendered | 0005| through direct assistance to individuals, couples, families, groups and | 0006| community organizations. Social work practice focuses on both direct | 0007| and indirect services to facilitate change on the intrapersonal, inter- | 0008| personal and systemic levels. Areas of specialization that address | 0009| these include but are not limited to the following: | 0010| (1) clinical social work practice, which is the pro- | 0011| fessional application of social work theory and methods in the diag- | 0012| nosis, treatment and prevention of psychosocial dysfunction, disability | 0013| or impairment, including but not limited to emotional and mental dis- | 0014| orders. It is based on knowledge of one or more theories of human de- | 0015| velopment within a psychosocial context. Clinical social work includes | 0016| interventions directed to interpersonal interactions, intrapsychic dy- | 0017| namics or life support and management issues. Clinical social work | 0018| services consist of assessment, diagnosis and treatment, including | 0019| psychotherapy and counseling, client-centered advocacy, consultation and | 0020| evaluation; | 0021| (2) social work research practice, which is the | 0022| professional study of human capabilities and practice of social work | 0023| specialties, including direct and indirect practice, through the formal | 0024| organization and the methodology of data collection and the analysis and | 0025| evaluation of social work data; | 0001| (3) social work community organization, planning and | 0002| development practice, which is a conscious process of social interaction | 0003| and method of social work concerned with the meeting of broad needs and | 0004| bringing about and maintaining adjustment between needs and resources in | 0005| a community or other areas; helping people to deal more effectively with | 0006| their problems and objectives by helping them develop, strengthen and | 0007| maintain qualities of participation, self-direction and cooperation; and | 0008| bringing about changes in community and group relationships and in the | 0009| distribution of decision-making power. The community is the primary | 0010| client in community organizations. The community may be an | 0011| organization, neighborhood, city, county, state or national entity; | 0012| (4) social work administration, which is the practice | 0013| that is concerned primarily with translating laws, technical knowledge | 0014| and administrative rulings into organizational goals and operational | 0015| policies to guide organizational behavior; designing organizational | 0016| structure and procedures or processes through which social work goals | 0017| can be achieved; and securing resources in the form of material, staff, | 0018| clients and societal legitimation necessary for goal attainment and | 0019| organizational survival; and | 0020| (5) university social work faculty, which provides an | 0021| equal quality of social work education in identified areas of content; | 0022| prepares graduates to practice in a range of geographic areas with | 0023| diverse populations; and establishes the foundation for practitioners' | 0024| professional futures, exposing them to the best of current knowledge and | 0025| developing in them the ability to continue questioning and learning, as | 0001| well as an awareness of their responsibility to continue this profes- | 0002| sional development." | 0003| Section 15. Section 61-31-7 NMSA 1978 (being Laws 1989, Chapter | 0004| 51, Section 7) is amended to read: | 0005| "61-31-7. BOARD CREATED.-- | 0006| A. There is created the "board of social work examiners". | 0007| B. The board shall be administratively attached to the de- | 0008| partment. | 0009| C. The board shall consist of seven members who are repre- | 0010| sentative of the geographic and ethnic groups within New Mexico, who are | 0011| United States citizens and who have been New Mexico residents for at | 0012| least five years prior to their appointment. Of the seven members: | 0013| (1) four members shall have been engaged in social | 0014| work practice for at least five years; at least two of the four shall | 0015| hold a master's degree in social work; and at least two shall hold a | 0016| bachelor's degree in social work from schools of social work that are | 0017| accredited by the council on social work education. At least one of | 0018| these members shall be engaged primarily in clinical social work prac- | 0019| tice; one member shall be engaged primarily in education; one member | 0020| shall be engaged primarily in administration or research in social work | 0021| practice; and at least one member shall be engaged primarily in com- | 0022| munity organization, planning and development. These members shall not | 0023| hold office in any professional organization of social workers during | 0024| their tenure on the board; and | 0025| (2) three members shall represent the public. The | 0001| public members shall not have been licensed or have practiced as social | 0002| workers. Public members shall not have any significant financial in- | 0003| terest, whether direct or indirect, in social work practice. | 0004| D. Members of the board shall be appointed by the governor | 0005| for staggered terms of three years, except that, in making the initial | 0006| appointments, three members shall be appointed for terms ending June 30, | 0007| 1990; three members for terms ending June 30, 1991; and four members for | 0008| terms ending June 30, 1992. Each member shall hold office until his | 0009| successor is appointed. Vacancies shall be filled for the unexpired | 0010| term in the same manner as original appointments. | 0011| E. Except for the representatives of the public on the | 0012| board, the governor shall appoint board members from a list of nominees | 0013| submitted by social work organizations and individual social work pro- | 0014| fessionals. | 0015| F. Members of the board shall be reimbursed as provided in | 0016| the Per Diem and Mileage Act and shall receive no other compensation, | 0017| perquisite or allowance. | 0018| G. The board shall elect a chairman and other officers as | 0019| deemed necessary to administer its duties. | 0020| H. A simple majority of the board members currently serving | 0021| shall constitute a quorum of the board. | 0022| I. The board shall meet at least once a year and at such | 0023| other times as it deems necessary. Other meetings may be called by the | 0024| chairman upon the written request of a quorum of the board. | 0025| J. The governor may remove any member from the board for the | 0001| neglect of any duty required by law, for incompetence, for improper or | 0002| unprofessional conduct as defined by board regulation or for any reason | 0003| that would justify the suspension or revocation of his license to | 0004| practice social work. | 0005| K. In the event of a vacancy for any reason, the board sec- | 0010| retary shall immediately notify the governor and the board of the | 0011| vacancy and the reason for its occurrence to expedite the appointment of | 0012| a new board member within a six-month period." | 0013| Section 16. Section 61-31-14 NMSA 1978 (being Laws 1989, Chapter | 0014| 51, Section 14) is amended to read: | 0015| "61-31-14. LICENSE RENEWAL.-- | 0016| A. Each licensee shall renew his license annually by sub- | 0017| mitting a renewal application on a form provided by the board. At the | 0018| time of license renewal, the board shall require a licensee to produce | 0019| evidence of continuing education, as prescribed by the board. | 0020| B. A thirty-day grace period shall be allowed each licensee | 0021| after each annual licensing period, during which time licenses may be | 0022| renewed upon payment of the renewal fee and providing evidence of con- | 0023| tinuing education as required under the Social Work Practice Act. | 0024| C. Any licensee who allows his license to lapse for longer | 0025| than three months shall have the license automatically revoked and shall | 0001| be required to take a written examination. | 0002| D. A late penalty fee shall be assessed after the thirty-day | 0003| grace period has expired for anyone attempting to renew a license to | 0004| practice social work." | 0005| Section 17. Section 61-31-25 NMSA 1978 (being Laws 1989, Chapter | 0006| 51, Section 27) is amended to read: | 0007| "61-31-25. TERMINATION OF AGENCY LIFE--DELAYED REPEAL.--The board | 0008| of social work examiners is terminated on July 1, 1997 pursuant to the | 0009| Sunset Act. The board shall continue to operate according to the pro- | 0010| visions of the Social Work Practice Act until July 1, 1998. Effective | 0011| July 1, 1998, the Social Work Practice Act is repealed." | 0012| Section 18. TEMPORARY PROVISION--EXTENDED EFFECTIVE | 0013| DATE.--Vacancies on the board of social work examiners existing July 1, | 0014| 1996 shall not be filled. The provisions of Paragraph (1) of Subsection | 0015| C of Section 61-31-7 NMSA 1978 shall be implemented when board members | 0016| serving upon the effective date of this act are replaced due to term | 0017| expiration. | 0018| Section 19. REPEAL.--Sections 12-9-13 through 12-9-16.1 NMSA 1978 | 0019| (being Laws 1981, Chapter 241, Sections 3 through 6 and Laws 1990, | 0020| Chapter 16, Section 1, as amended) are repealed. | 0021| Section 20.
