0001| AN ACT | 0002| RELATING TO EDUCATION; CREATING THE PUBLIC EDUCATION STRATEGIC PLANNING | 0003| TEAM; PRESCRIBING POWERS AND DUTIES; ENACTING THE STRATEGIC PLANNING FOR | 0004| PUBLIC EDUCATION ACT; DECLARING AN EMERGENCY. | 0005| | 0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0007| Section 1. SHORT TITLE.--This act may be cited as the "Strategic | 0008| Planning for Public Education Act". | 0009| Section 2. FINDINGS AND PURPOSE.-- | 0010| A. The legislature finds that New Mexico has been involved | 0011| in multiple restructuring and systemic change initiatives to improve the | 0012| elementary and secondary educational system and that a comprehensive | 0013| framework for education that can sustain targeted goals and objectives | 0014| is necessary for long-term support from all branches of government and | 0015| the public. | 0016| B. The legislature finds that a comprehensive elementary and | 0017| secondary education framework can be established through a strategic | 0018| planning process that provides the opportunity for all branches of | 0019| government and the public to reach consensus about the purpose of | 0020| schooling and to concentrate all efforts, resources, activities and | 0021| energies toward maximizing the efficiency and effectiveness of the | 0022| educational system to best prepare New Mexico's students for the future. | 0023| C. It is the purpose of the Strategic Planning for Public | 0024| Education Act to: | 0025| (1) develop a statewide strategic plan for public | 0001| school education that provides a well-defined vision and articulated | 0002| steps to achieve national preeminence in education; | 0003| (2) gain statewide consensus by encouraging the | 0004| governor's office and related state agencies, the legislature, the state | 0005| board of education, the state department of public education, local | 0006| boards of education, school personnel, parents, students, the business | 0007| community and each school district's community to work together toward | 0008| the common goal of improving educational opportunities and performance | 0009| of all New Mexico's children and youth; and | 0010| (3) develop a plan to coordinate the state-level | 0011| planning cycle with the budgeting cycle to ensure that the strategic | 0012| plan drives state-level funding decisions. | 0013| Section 3. PUBLIC EDUCATION STRATEGIC PLANNING TEAM.-- | 0014| A. There is created a "public education strategic planning | 0015| team", which shall function from the date of its appointment until | 0016| December 31, 1996. | 0017| B. The public education strategic planning team shall be | 0018| composed of thirty members representative of the different geographical | 0019| areas of the state and reflective of the diverse population of the state | 0020| and shall be appointed as follows: | 0021| (1) two members from the house of representatives, one | 0022| from each party, appointed by the speaker of the house; | 0023| (2) two members from the senate, one from each party, | 0024| appointed by the president pro tempore of the senate; | 0025| (3) two members from the state board of education | 0001| appointed by the president of the state board of education; | 0002| (4) three members appointed by the governor from the | 0003| executive branch, of whom one shall be from the children, youth and | 0004| families department and one of whom shall be from the department of | 0005| health; | 0006| (5) nine members from the educational system who shall | 0007| include a local school board member, a superintendent, a principal, a | 0008| student, a classified staff member, a representative from higher | 0009| education and three teachers appointed jointly by the governor, the | 0010| speaker of the house, the president pro tempore of the senate and the | 0011| president of the state board of education; and | 0012| (6) twelve members of the public who shall include | 0013| parents and members of the business community appointed jointly by the | 0014| governor, the speaker of the house, the president pro tempore of the | 0015| senate and the president of the state board of education. | 0016| B. The legislative education study committee shall solicit | 0017| recommendations from the public and organizations representative of the | 0018| categories specified in Paragraphs (5) and (6) of Subsection A of this | 0019| section to compile a list of names from each of the categories listed. | 0020| The governor, the speaker of the house, the president pro tempore of the | 0021| senate and the president of the state board of education shall jointly | 0022| appoint the members from the educational system and members of the | 0023| public from the list provided by the legislative education study | 0024| committee. | 0025| C. Appointed members of the public education strategic | 0001| planning team shall be reimbursed as provided in the Per Diem and | 0002| Mileage Act and shall receive no other compensation, perquisite or | 0003| allowance. | 0004| Section 4. DUTIES.-- | 0005| A. The public education strategic planning team shall: | 0006| (1) develop and reach consensus on a statewide | 0007| strategic plan for New Mexico public schools that makes New Mexico | 0008| preeminent in education in the nation. The plan shall include the | 0009| development of a mission statement focused on objectives and strategies | 0010| that may include issues such as professional development, accountability | 0011| and resource planning; | 0012| (2) review and approve action plans to ensure that | 0013| each action plan is aligned with the vision and goals of the statewide | 0014| strategic plan and clearly delineates timelines, expected outcomes and | 0015| parties responsible for carrying out the action plans; | 0016| (3) develop a consensus-building strategy to inform | 0017| the public and develop consensus among New Mexicans about the strategic | 0018| plan; and | 0019| (4) develop and recommend a schedule of implementation | 0020| for the strategies and action plans that includes a program budgeting | 0021| system having a year-by-year cost projection for implementing the plans. | 0022| B. In developing the statewide strategic plan, the public | 0023| education strategic planning team shall allow for the autonomy of local | 0024| districts and shall take into account existing initiatives that the | 0025| state has been involved in, including the legislative education study | 0001| committee's initiatives, the state board of education's consolidating | 0002| initiatives for tomorrow's education, school-to-work and other state | 0003| agency initiatives and state and local district initiatives. | 0004| Section 5. REPORT.--The public education strategic planning team | 0005| shall make a report of its findings and recommendations to the first | 0006| session of the forty-third legislature regarding necessary legislation | 0007| to begin implementation of the statewide strategic plan, including in | 0008| its recommendations a plan for annual updates of the strategic statewide | 0009| plan on ways to coordinate the planning cycle with the budgeting cycle | 0010| to ensure that the strategic plan drives state funding decisions; to | 0011| assess progress as measured by the strategies and action plans; and to | 0012| make modifications and adjustments to the statewide strategic plan. The | 0013| report of findings and recommendations shall be made available to the | 0014| speaker of the house, the president pro tempore of the senate, the | 0015| legislative education study committee, the governor and the state board | 0016| of education no later than November 15, 1996. | 0017| Section 6. STAFF.--The staff for the public education strategic | 0018| planning team and action teams shall be provided by the legislative | 0019| education study committee, the governor's office and the state board of | 0020| education. The staff shall be responsible for compilation of current | 0021| education data and information for review and use by the planning teams, | 0022| coordination of meetings and overall management of the project. The | 0023| legislative education study committee in cooperation with the state | 0024| board of education and the governor's office shall coordinate the | 0025| project. The legislative education study committee, in consultation | 0001| with the state board of education and the governor's office, may | 0002| contract for strategic planning assistance. | 0003| Section 7. EMERGENCY.--It is necessary for the public peace, | 0004| health and safety that this act take effect immediately. |
