0001| AN ACT | 0002| RELATING TO PUBLIC SCHOOLS; DELAYING THE MANDATORY EMPLOYMENT OF SCHOOL | 0003| NURSES UNTIL JULY 1, 1997. | 0004| | 0005| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0006| Section 1. Section 22-8-9 NMSA 1978 (being Laws 1967, Chapter 16, | 0007| Section 63, as amended by Laws 1993, Chapter 226, Section 19) is amended | 0008| to read: | 0009| "22-8-9. BUDGETS--MINIMUM REQUIREMENTS.-- | 0010| A. No budget for a school district shall be approved by the | 0011| department that does not provide for: | 0012| (1) a school year consisting of at least one hundred | 0013| eighty full instructional days or the equivalent thereof, exclusive of | 0014| any release time for in-service training; or | 0015| (2) a variable school year consisting of a minimum | 0016| number of instructional hours established by the state board; and | 0017| (3) a pupil-teacher ratio or class or teaching load as | 0018| provided in Section 22-2-8.2 NMSA 1978; and | 0019| (4) effective July 1, 1997, a full-time, department-certified nurse for each fifty-five teachers employed by a school | 0020| district or the equivalent part-time, department-certified nurse for | 0021| less than fifty-five teachers. | 0022| B. The state board shall, by regulation, establish the | 0023| requirements for a teaching day, the standards for an instructional hour | 0024| and the standards for a full-time certified classroom instructor and for | 0025| the equivalent thereof. | 0001| C. The local school board shall submit a plan for the | 0002| implementation of an alternate school year to the state superintendent | 0003| for his approval. | 0004| D. The provisions of Subsection C and Paragraph (2) of | 0005| Subsection A of this section shall be construed to apply only to school | 0006| districts with a MEM of one thousand or fewer." | 0007| Section 2. REPEAL.--That version of Section 22-8-9 NMSA 1978 | 0008| (being Laws 1967, Chapter 16, Section 63, as amended) that is to become | 0009| effective July 1, 1995 pursuant to Laws 1993, Chapter 223, Section 1 is | 0010| repealed. | 0011| Section 3. REPEAL.--That version of Section 22-8-9 NMSA 1978 | 0012| (being Laws 1967, Chapter 16, Section 63, as amended) that is to become | 0013| effective July 1, 1996 pursuant to Laws 1994, Chapter 68, Section 1, as | 0014| amended by Laws 1995, Chapter 151, Section 1, is repealed. | 0015| | 0016| | 0017| HB | 0018| 29 | 0019| Page  |
