HOUSE FLOOR AMENDMENT number ___1__ to HOUSE ENERGY, ENVIRONMENT AND NATURAL RESOURCES COMMITTEE SUBSTITUTE FOR HOUSE AGRICULTURE, ACEQUIAS AND WATER RESOURCES COMMITTEE SUBSTITUTE FOR HOUSE BILL 137, as amended

Amendment sponsored by Representative Jack Chatfield

    1. On page 3, line 10, after "law", insert ", including public notice, public hearing processes and all other associated requirements related to public involvement,".

    2. On page 4, line 5, after "pueblo", insert "located wholly or partially in New Mexico".

    3. On page 4, line 12, after "law", insert ", including public notice, public hearing processes and all other associated requirements related to public involvement,".

    4. On page 5, between lines 14 and 15, insert:

         "I. In connection with any strategic water supply program

contract or grant that is subject to the notice of intention filing requirements pursuant to Section 72-12-26 NMSA 1978, the office of the state engineer shall provide an opportunity for a federally recognized Indian nation, tribe or pueblo located wholly or partially in New Mexico, a person, a firm, a corporation or other entity to file an objection or protest through a process consistent with the provisions of Section 72-12-3 NMSA 1978 regarding a determination by the state engineer made pursuant to Section 72-12-26 NMSA 1978.".

    5. On page 6, line 23, strike "ten" and insert in lieu thereof "thirty".
