A MEMORIAL
REQUESTING THAT AN IGNITION INTERLOCK TASK FORCE BE ESTABLISHED TO ENSURE THAT DRIVERS USING AN IGNITION INTERLOCK DEVICE ARE INSURED AT LEVELS REQUIRED BY THE MANDATORY FINANCIAL RESPONSIBILITY ACT.
WHEREAS, New Mexico law mandates an ignition interlock license and the installation of an ignition interlock device on every vehicle driven by anyone in the state who has been convicted of driving while under the influence of intoxicating liquor or drugs or convicted of homicide by vehicle or great bodily harm by vehicle while under the influence of intoxicating liquor or drugs; and
WHEREAS, a driver must show proof of insurance in order to obtain an ignition interlock license and ignition interlock device; and
WHEREAS, a driver with an ignition interlock license will be driving for a minimum of six months with an ignition interlock device;
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF NEW MEXICO that the traffic safety bureau of the department of transportation and the motor vehicle division of the taxation and revenue department be requested to form an ignition interlock task force that includes stakeholders to study and track whether drivers with an ignition interlock license are insured at levels required by the Mandatory Financial Responsibility Act during the entire time those drivers are required to use an ignition interlock device; and
BE IT FURTHER RESOLVED that the ignition interlock task force be requested to make recommendations to ensure that drivers with ignition interlock licenses maintain the required level of insurance when driving on roads in the state; and
BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the secretary of transportation and the director of the motor vehicle division of the taxation and revenue department.
