AN ACT

RELATING TO ARTIFICIAL INTELLIGENCE; PROVIDING FOR A WORK GROUP ON ARTIFICIAL INTELLIGENCE SYSTEMS; REQUIRING REPORTS; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 9-27A-1 NMSA 1978 (being Laws 2023, Chapter 115, Section 1) is amended to read:

     "9-27A-1. SHORT TITLE.--[This act] Chapter 9, Article 27A NMSA 1978 may be cited as the "Cybersecurity Act"."

     SECTION 2. A new section of the Cybersecurity Act is enacted to read:

     "[NEW MATERIAL] ARTIFICIAL INTELLIGENCE WORK GROUP--REPORTS.--

          A. The security officer shall convene a work group to develop legislative proposals and recommendations for policies for state use and procurement of artificial intelligence systems. Agencies shall cooperate with the work group, including providing information, data, records and reports regarding an agency's use or procurement of artificial intelligence systems upon request.

          B. The security officer is a voting member and shall chair the work group. The remaining members of the work group consist of:

                (1) one member appointed by the chief justice of the supreme court;

                (2) one member appointed by the president pro tempore of the senate;

                (3) one member appointed by the speaker of the house of representatives;

                (4) the secretary of information technology or the secretary's designee; and

                (5) four representatives appointed by the governor who are not employees of the department of information technology.

          C. The work group shall meet at the discretion of the security officer, but at a minimum of four times a year. The cybersecurity office shall provide administrative support for the work group and may contract for professional service providers to support the work group.

          D. By November 1, 2025, the work group shall submit a report of its activities and recommendations to the legislative finance committee, the appropriate legislative committee focused on science and technology issues and the governor.

          E. The members of the work group shall receive no pay for their services as members but shall be allowed per diem and mileage pursuant to the provisions of the Per Diem and Mileage Act. All per diem and contingent expenses incurred by the work group or the cybersecurity office shall be paid upon warrants of the secretary of finance and administration, supported by vouchers of the cybersecurity office.

          F. As used in this section, "artificial intelligence system" means a hardware or software system using algorithms to process and interpret data to imitate intelligent behavior for specific decision-making goals. "Artificial intelligence system" includes systems capable of incorporating new data to expand the technology's capacity for interpretation, including directed or automatic access of data from the internet."

     SECTION 3. APPROPRIATION.--Five hundred thousand dollars ($500,000) is appropriated from the general fund to the cybersecurity office for expenditure in fiscal years 2025 and 2026 for staffing and support services for the artificial intelligence work group. Any unexpended or unencumbered balance remaining at the end of fiscal year 2026 shall revert to the general fund.

     SECTION 4. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2024.
