AN ACT

RELATING TO TECHNOLOGY; CREATING THE DATA INTEGRATION ADVISORY COMMITTEE TO STUDY, REPORT AND PROVIDE RECOMMENDATIONS ON THE MAINTENANCE AND UTILIZATION OF DATA IN STATE GOVERNMENT; REQUIRING REPORTING; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. TEMPORARY PROVISION--DATA INTEGRATION ADVISORY COMMITTEE--CREATED--DUTIES--REPORTING.--

          A. The "data integration advisory committee" is created in the department of information technology. The data integration advisory committee shall exist from the date of its appointment, which shall be no later than August 1, 2023, until January 1, 2026. Staff and administrative support for the committee shall be coordinated by the New Mexico institute of mining and technology's institute for complex additive systems analysis. The committee consists of the following members:

                (1) the director of the institute for complex additive systems analysis at the New Mexico institute of mining and technology or the director's designee, who shall be the chair;

                (2) the secretary of information technology;

                (3) one member or designee of the senate who shall have expertise in the application of technological solutions to public sector data, appointed by the president pro tempore of the senate;

                (4) one member or designee of the house of representatives who shall have expertise in the application of technological solutions to public sector data, appointed by the speaker of the house of representatives;

                (5) one member who represents the office of the attorney general, appointed by the attorney general;

                (6) one member who is an attorney or is an expert in data sharing and compliance, appointed by the governor;

                (7) one member who is an expert in education and educational systems in New Mexico, appointed by the governor;

                (8) one member who is an expert in health care and public health in New Mexico, appointed by the governor;

                (9) one member who represents state courts, appointed by the chief justice of the supreme court;

                (10) one member who represents counties who shall have expertise in the application of technological solutions to public sector data, appointed by New Mexico association of counties; and

                (11) one member who represents cities who shall have expertise in the application of technological solutions to public sector data, appointed by the New Mexico municipal league.

          B. Public members of the data integration advisory committee are entitled to receive per diem and mileage pursuant to the Per Diem and Mileage Act but shall receive no other compensation, perquisite or allowance.

          C. The data integration advisory committee shall meet at a frequency that is necessary to complete its duties or as determined by the New Mexico institute of mining and technology.

          D. A vacancy on the data integration advisory committee shall be filled by the original appointing authority.

          E. A majority of members constitutes a quorum for the transaction of business.

          F. Meetings of the data integration advisory committee shall be subject to the Open Meetings Act.

          G. The data integration advisory committee shall conduct a statewide study on the current data structure, sharing and reporting protocols for all state and local agencies and entities that have access to data stored by state and local agencies. The study shall determine:

                (1) current gaps in data maintenance and utilization;

                (2) mapping of data sharing flows between agencies; and

                (3) the costs and processes necessary to centralize the storage and protection of data.

          H. Upon completion of the study, the data integration advisory committee shall:

                (1) establish suggested procedures to ensure that data are compiled, maintained and shared efficiently to promote a streamlined experience for public users; and

                (2) recommend a long-term data governance structure to promote statewide data management and sharing.

          I. On or before January 1, 2025, the data integration advisory committee shall complete its work and present to the legislative finance committee a summary of the advisory committee's findings, including, if appropriate, proposals for legislation.

          J. From January 1, 2025 through January 1, 2026, the data integration advisory committee shall coordinate with the New Mexico institute of mining and technology to incorporate feedback from the legislative finance committee in the data integration advisory committee's report and submit final recommendations and procedures for statewide data management to the legislature, the executive and other impacted entities by January 1, 2026.

          K. As used in this section:

                (1) "data" means any versions of statistical or factual information that are reflected in a list, table, graph, chart or other non-narrative form that can be digitally or non-digitally transmitted or processed; and

                (2) "agency" means any board, commission, department, office or other administrative unit of the state or of a local government, including the agency head, agency staff or other persons purporting to act on behalf of or under the authority of the agency.  

     SECTION 2. APPROPRIATION.--Two million dollars ($2,000,000) is appropriated from the general fund to the board of regents of the New Mexico institute of mining and technology for expenditure in fiscal years 2024 and 2025 to convene, organize and manage the data integration advisory committee to conduct a statewide data inventory study and to oversee the development of the associated report to the legislative finance committee. Any unexpended or unencumbered balance remaining at the end of fiscal year 2025 shall revert to the general fund.
