Your HEALTH AND PUBLIC AFFAIRS COMMITTEE, to whom has been referred
SENATE BILL 103
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 2, lines 7 and 8, strike "and obtain electronic fingerprinting data" and insert in lieu thereof "a fingerprint-based criminal history record".
2. On page 2, lines 13 and 14, strike "provide the electronic fingerprinting data obtained" and insert in lieu thereof "request the fingerprint-based criminal history record".
3. On page 2, line 15, strike the second occurrence of "to" and insert in lieu thereof "from".
4. On page 2, lines 22 and 23, strike "electronic fingerprinting data" and insert in lieu thereof "fingerprint-based criminal history record".
5. On page 4, line 22, after the period, insert "The secretary may deny or terminate employment of a person who has been convicted of a felony or a crime involving moral turpitude that has a direct impact on the suitability of that person to access federal tax information.".
6. On page 5, line 21, after "section", insert "shall receive a written determination from the department that states the reason for the decision. That person".
7. On page 5, lines 22 and 23, strike "appeal the decision" and insert in lieu thereof "request administrative reconsideration by submitting a written appeal to the secretary within fifteen calendar days of the decision to deny or terminate employment. A person may appeal the final decision of the secretary".
8. On page 5, line 24, strike "39-1-1.1" and insert in lieu thereof "39-3-1.1".
9. On page 5, line 25, after the second occurrence of "the", insert "secretary's final".,
and thence referred to the JUDICIARY COMMITTEE.
