AN ACT

RELATING TO PUBLIC EDUCATION; CREATING THE NATIVE AMERICAN WEB-BASED RESOURCE TOOL FOR NATIVE AMERICAN STUDENTS; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Public School Code is enacted to read:

     "[NEW MATERIAL] NATIVE AMERICAN WEB-BASED RESOURCE TOOL FOR NATIVE AMERICAN STUDENTS--CREATION--CONTENTS--TRIBAL OWNERSHIP.--

          A. The department shall develop, in collaboration with the Indian nations, tribes and pueblos of the state, a Native American web-based tool that provides resources for Native American students.

          B. The Native American web-based resource tool may contain the following:

                (1) information on educational programs focused on the needs of Native American students;

                (2) modules, interventions and educational approaches conducive to the educational needs of Native American students; and

                (3) information on local and regional Native American educational experts.

          C. All intellectual property provided by an Indian nation, tribe or pueblo shall belong to that Indian nation, tribe or pueblo and shall be provided to the department through a joint powers agreement with each individual Indian nation, tribe or pueblo.

          D. The department shall enter into a joint powers agreement in accordance with Section 11-1-3 NMSA 1978 with an Indian nation, tribe or pueblo to receive any intellectual property provided pursuant to Subsection C of this section.

          E. The department shall host the Native American web-based resource tool on the department's website and employ a full-time staff member to oversee and maintain the Native American web-based resource tool."

     SECTION 2. APPROPRIATION.--Two hundred fifty thousand dollars ($250,000) is appropriated from the general fund to the public education department for expenditure in fiscal year 2023 to develop and host the Native American web-based resource tool and to hire a full-time employee to oversee the web-based resource tool. Any unexpended or unencumbered balance remaining at the end of fiscal year 2023 shall revert to the general fund.
