AN ACT
RELATING TO SPORTS; CHANGING THE FOCUS OF THE SPORTS AUTHORITY DIVISION OF THE TOURISM DEPARTMENT; CLARIFYING DUTIES; ADDING MEMBERS TO AND CHANGING THE NAME OF THE SPORTS ADVISORY COMMITTEE; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. Section 9-15A-10 NMSA 1978 (being Laws 2007, Chapter 286, Section 2 and Laws 2007, Chapter 287, Section 2) is amended to read:
"9-15A-10. DUTIES OF THE SPORTS AUTHORITY DIVISION.--
A. The sports authority division of the department shall:
(1) develop an overall strategic plan for recruiting and retaining all forms of professional and amateur sporting teams, leagues and events;
(2) identify and inventory existing infrastructure for sporting activities, identify and propose future infrastructure and locations and identify opportunities for private and public partnerships on infrastructure;
(3) foster relationships between sporting team, league and event organizers and team, league and event sponsors; and
(4) foster relationships among state and local agencies and provide advice and direction needed to increase the number and quality of sporting teams, leagues and events held in New Mexico.
B. The sports authority division may promulgate rules as necessary to:
(1) provide additional professional and amateur sports participation by New Mexico residents;
(2) provide for the welfare of sports participants [in sporting events];
(3) provide for adequate safety measures for and ethical operation of sporting teams, leagues and events;
(4) recruit and maintain professional and amateur sporting teams, leagues and events to be held in New Mexico; and
(5) address the fiscal and tax implications of Paragraphs (1) through (4) of this subsection."
SECTION 2. Section 9-15A-11 NMSA 1978 (being Laws 2007, Chapter 286, Section 3 and Laws 2007, Chapter 287, Section 3) is amended to read:
"9-15A-11. NEW MEXICO SPORTS [ADVISORY COMMITTEE] AMBASSADORS.--
A. The "New Mexico sports [advisory committee] ambassadors" is created to advise and support the sports authority division of the department.
B. The New Mexico sports [advisory committee] ambassadors consists of the lieutenant governor or lieutenant governor's designee, the secretary of economic development or the secretary's designee and the secretary of tourism or the secretary's designee and a minimum of twenty-five members of the public appointed by the governor [and six ex-officio voting members as follows:
(1) the superintendent of regulation and licensing;
(2) the secretary of economic development; (3) the secretary of tourism
(4) the secretary of taxation and revenue;
(5) the chief counsel to the governor; and
(6) the governor's deputy chief of staff for legislative affairs.
C. An ex-officio member may designate in writing another person to attend meetings of the committee and to the same extent and with the same effect act in the ex-officio member's stead]. The public members shall include:
(1) a representative of the New Mexico activities association;
(2) an athletic director of a high school;
(3) an athletic director of a school district;
(4) a representative of the athletics department of an institution of higher education;
(5) a college coach of a men's sports team;
(6) a college coach of a women's sports team;
(7) a high school coach of a boys' sports team;
(8) a high school coach of a girls' sports team;
(9) a representative of an internet site dedicated to New Mexico sports;
(10) a representative of a professional sports franchise;
(11) a sports broadcaster;
(12) a representative of the New Mexico sports hall of fame;
(13) a sports journalist;
(14) a sports radio personality; and
(15) a representative of a youth baseball league.
[D.] C. Public members shall be appointed for four-year terms expiring on January 1 and shall serve at the pleasure of the governor. Members serve until their successors have been appointed and qualified. The governor may fill any vacancies on the [committee] New Mexico sports ambassadors for the remainder of an unexpired term.
[E.] D. The [committee] New Mexico sports ambassadors shall have two co-chairs appointed by the governor, one of whom shall be an ex-officio member and one of whom shall be a public member. The [committee] New Mexico sports ambassadors may elect such other officers as it deems necessary to carry out its duties.
[F.] E. Public members of the [committee shall] New Mexico sports ambassadors are entitled to receive per diem and mileage as provided for nonsalaried public officers in the Per Diem and Mileage Act and shall receive no other compensation, perquisite or allowance.
[G.] F. Representation on the [committee] New Mexico sports ambassadors shall resemble the demographics of New Mexico [in conjunction with the three congressional districts] and provide for geographic balance across the state."
SECTION 3. APPROPRIATION.--One million dollars ($1,000,000) is appropriated from the general fund to the tourism department for expenditure in fiscal year 2023 for the sports authority division to carry out expanded duties. Any unexpended or unencumbered balance remaining at the end of fiscal year 2023 shall revert to the general fund.
