AN ACT

MAKING AN APPROPRIATION TO THE PUBLIC EDUCATION DEPARTMENT FOR THE DEVELOPMENT OF A CYBERSECURITY PROGRAM FOR THE STATEWIDE EDUCATION TECHNOLOGY INFRASTRUCTURE NETWORK, INCLUDING EIGHTY-SEVEN SCHOOL DISTRICTS AND SEVENTY-THREE CHARTER OR OTHER SCHOOLS BY THE END OF FISCAL YEAR 2026.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. APPROPRIATION.--

          A. Forty-five million dollars ($45,000,000) is appropriated from the general fund to the public education department for expenditure in fiscal years 2023 through 2026 for three full-time employees and to develop and implement a cybersecurity program for the statewide education technology infrastructure network developed pursuant to Section 22-24-4.5 NMSA 1978. The cybersecurity program shall include cybersecurity insurance support, cybersecurity planning and project management, development of a response and recovery plan and quarterly reviews, hardening of cyber-environment infrastructure, operations, processes and systems, monitoring network activity and training for employees and students.

The expenditure per year shall be as follows:

                (1) eight million dollars ($8,000,000) in fiscal year 2023 to plan, implement and maintain a cybersecurity program for thirty-five school districts and eighteen charter or other schools;

                (2) ten million dollars ($10,000,000) in fiscal year 2024 to maintain the cybersecurity program and extend it to an additional twenty school districts and eighteen charter or other schools;

                (3) twelve million dollars ($12,000,000) in fiscal year 2025 to maintain the cybersecurity program and extend it to an additional sixteen school districts and eighteen charter or other schools; and

                (4) fifteen million dollars ($15,000,000) in fiscal year 2026 to maintain the cybersecurity program and extend it to an additional sixteen school districts and nineteen charter or other schools.

          B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2026 shall revert to the general fund.
