AN ACT

MAKING APPROPRIATIONS FROM THE APPROPRIATION CONTINGENCY FUND, FROM CERTAIN FEDERAL FUNDS ALLOCATED TO THE STATE, FOR EXPENDITURES RELATING TO PUBLIC HEALTH.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. TRANSFER--APPROPRIATION CONTINGENCY FUND.--Of the federal funds received in the state treasury in the coronavirus state fiscal recovery fund pursuant to the federal American Rescue Plan Act of 2021, Sec. 9901, Public Law 117-2, 135 Stat. 223, one billion sixty-nine million one hundred seventy-five thousand dollars ($1,069,175,000) is transferred to the appropriation contingency fund of the general fund.

     SECTION 2. APPROPRIATIONS--APPROPRIATION CONTINGENCY FUND.--Of the one billion sixty-nine million one hundred seventy-five thousand dollars ($1,069,175,000) transferred to the appropriation contingency fund of the general fund pursuant to Section 1 of this 2021 act, the following amounts are appropriated for expenditure in fiscal years 2022 through 2025, and any unexpended or unencumbered balance remaining at the end of fiscal year 2025 shall revert to the appropriation contingency fund:

          A. fifty million dollars ($50,000,000) to the board of regents of the university of New Mexico to plan, design, construct, improve, renovate, furnish and equip facilities for a school of public health at the university of New Mexico health sciences center;

          B. twenty million dollars ($20,000,000) to the board of regents of the university of New Mexico for salaries and operational expenses for a school of public health at the university of New Mexico health sciences center;

          C. five million dollars ($5,000,000) to the board of regents of the university of New Mexico for development of a program for a school of public health at the university of New Mexico health sciences center;

          D. forty million dollars ($40,000,000) to the board of regents of the university of New Mexico for equipment to provide proton therapy for the cancer center at the university of New Mexico health sciences center;

          E. one hundred million dollars ($100,000,000) to the human services department to allow the interagency behavioral health purchasing collaborative to develop and expand behavioral health services statewide;

          F. ten million dollars ($10,000,000) to the department of health for perinatal care services statewide;

          G. ten million dollars ($10,000,000) to the department of health to collaborate with the university of New Mexico health sciences center to provide obstetric care services in Las Vegas in San Miguel county and Gallup in McKinley county;

          H. fifty million dollars ($50,000,000) to the higher education program development enhancement fund for the expansion of behavioral health faculty; and

          I. fifty million dollars ($50,000,000) to the higher education program development enhancement fund for the expansion of nursing faculty.

     SECTION 3. REPORT.--Each state agency or state educational institution to which an appropriation is made pursuant to Section 2 of this 2021 act shall report on the expenditure of those appropriations and the agency's or educational institution's strategic plan for the expenditures to the legislative finance committee by November 30 of each year through November 30, 2025.
