AN ACT

RELATING TO THE REDISTRICTING OF THE HOUSE OF REPRESENTATIVES; ESTABLISHING REPRESENTATIVE DISTRICTS; PROVIDING THE METHOD FOR ELECTING REPRESENTATIVES; PROVIDING FOR THE FILLING OF VACANCIES; SETTING PRECINCTS; FIXING THE NUMBER, RESIDENCE AND TERMS OF REPRESENTATIVES; REPEALING AND ENACTING SECTIONS OF THE NMSA 1978.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be cited as the "2021 House Redistricting Act".

     SECTION 2. [NEW MATERIAL] MEMBERSHIP.--The house of representatives is composed of seventy members to be elected from districts that are contiguous and that are as compact as is practicable.

     SECTION 3. [NEW MATERIAL] RESIDENCE.--At the time of filing a declaration of candidacy for the office of representative, a candidate shall reside in the district for which the candidate files. Thereafter, if a representative permanently removes the representative's residence from or maintains no residence in the district from which the representative was elected, the representative shall be deemed to have resigned, and a successor shall be selected as provided in Section 4 of the 2021 House Redistricting Act.

     SECTION 4. [NEW MATERIAL] ELECTIONS--VACANCIES.--

          A. Members of the house of representatives shall be elected for terms of two years.

          B. If a vacancy occurs in the office of representative for any reason, the vacancy shall be filled as follows:

                (1) for a representative district that is situated wholly within the exterior boundaries of a single county, the board of county commissioners of that county shall appoint the representative to fill the vacancy; and

                (2) for a representative district situated within two or more counties:

                     (a) the board of county commissioners of each county in the representative district shall submit one name to the governor; and

                     (b) the governor shall appoint the representative to fill the vacancy from the list of names so submitted.

          C. An appointment to fill a vacancy in the house of representatives shall be for a term ending on December 31 after the next general election.

          D. An appointment to fill a vacancy made before the general election of 2022 shall be made from the district as it was described in Section 2-7E-1 NMSA 1978, as established by the court in Egolf v. Duran, D-101-CV-2011-02942 (1st Dist. Ct., Judgment and Final Order on Remand (State House of Representatives Trial) filed February 28, 2012). On or after the general election of 2022, a vacancy shall be filled by appointment from the district as set out in the 2021 House Redistricting Act.

     SECTION 5. [NEW MATERIAL] PRECINCTS.--

          A. Precinct designations and boundaries used in the 2021 House Redistricting Act are those precinct designations and boundaries established pursuant to the Precinct Boundary Adjustment Act and revised and approved pursuant to that act by the secretary of state as of November 30, 2021.

          B. A board of county commissioners shall not create any precinct that lies in more than one representative district and shall not divide any precinct so that the divided parts of the precinct are situated in two or more representative districts. Votes cast in any general, primary or other statewide election from precincts created or divided in violation of this subsection are invalid and shall not be counted or canvassed.

     SECTION 6. [NEW MATERIAL] DISTRICTS.--The districts of the house of representatives shall be as set out in Sections 7 through 76 of the 2021 House Redistricting Act.

     SECTION 7. [NEW MATERIAL] REPRESENTATIVE DISTRICT ONE.--Representative district one is composed of San Juan county precincts 28, 30 through 32, 39 through 42, 44, 46 through 49, 55, 57 through 59, 67, 99, 102 through 104 and 106 through 108.

     SECTION 8. [NEW MATERIAL] REPRESENTATIVE DISTRICT TWO.--Representative district two is composed of San Juan county precincts 19, 29, 33 through 38, 43, 45, 50 through 54, 56, 77, 82, 100, 101, 105 and 109.

     SECTION 9. [NEW MATERIAL] REPRESENTATIVE DISTRICT THREE.--Representative district three is composed of San Juan county precincts 16, 60 through 66, 68 through 76, 78 through 81, 83 and 90.

     SECTION 10. [NEW MATERIAL] REPRESENTATIVE DISTRICT FOUR.--Representative district four is composed of San Juan county precincts 1 through 8, 18, 20 through 27, 110, 120, 121 and 130 through 134.

     SECTION 11. [NEW MATERIAL] REPRESENTATIVE DISTRICT FIVE.--Representative district five is composed of Cibola county precincts 6 and 14 through 16; McKinley county precincts 5, 7, 8, 15, 17 through 19, 23, 24, 36, 43, 46, 47, 49, 51 through 53, 56, 61, 63, 67 and 70; and San Juan county precincts 9 through 13 and 17.

     SECTION 12. [NEW MATERIAL] REPRESENTATIVE DISTRICT SIX.--Representative district six is composed of Catron county precinct 7; Cibola county precincts 1, 5, 7, 8, 12, 13, 17, 26 and 28 through 30; McKinley county precincts 25 through 30, 50, 54, 64 through 66 and 69; Socorro county precincts 15 and 24; and Valencia county precincts 1 and 27.

     SECTION 13. [NEW MATERIAL] REPRESENTATIVE DISTRICT SEVEN.--Representative district seven is composed of Valencia county precincts 2, 4 through 6, 8 through 11, 14, 15, 18, 22, 28, 32, 36, 40, 43, 45, 49, 50, 57, 58 and 60 through 63.

     SECTION 14. [NEW MATERIAL] REPRESENTATIVE DISTRICT EIGHT.--Representative district eight is composed of Valencia county precincts 3, 7, 12, 17, 19, 21, 23, 25, 26, 31, 35, 37, 39, 41, 42, 44, 51 through 55, 59 and 64 through 66.

     SECTION 15. [NEW MATERIAL] REPRESENTATIVE DISTRICT NINE.--Representative district nine is composed of McKinley county precincts 1 through 4, 6, 20 through 22, 31 through 35, 37 through 42, 44, 45, 48, 55, 57 through 59 and 68.

     SECTION 16. [NEW MATERIAL] REPRESENTATIVE DISTRICT TEN.--Representative district ten is composed of Bernalillo county precincts 90 through 92, 94 through 99, 101 through 107, 109, 133, 135, 213, 223 through 226, 235, 246, 260, 262, 266, 288, 629 and 630.

     SECTION 17. [NEW MATERIAL] REPRESENTATIVE DISTRICT ELEVEN.--Representative district eleven is composed of Bernalillo county precincts 121 through 125, 131, 132, 150 through 155, 161 through 166, 181, 183 through 188, 197, 211, 212, 221, 276, 345, 613, 634, 640 and 646.

     SECTION 18. [NEW MATERIAL] REPRESENTATIVE DISTRICT TWELVE.--Representative district twelve is composed of Bernalillo county precincts 44, 49, 60, 71 through 77, 139, 140, 143, 147, 148, 239, 240, 269, 340, 367, 604 and 654.

     SECTION 19. [NEW MATERIAL] REPRESENTATIVE DISTRICT THIRTEEN.--Representative district thirteen is composed of Bernalillo county precincts 42, 52 through 54, 59, 138, 141, 142, 144 through 146, 237, 247, 250, 267, 268, 270, 600, 620, 638 and 655.

     SECTION 20. [NEW MATERIAL] REPRESENTATIVE DISTRICT FOURTEEN.--Representative district fourteen is composed of Bernalillo county precincts 32, 33, 43, 45 through 48, 50, 51, 61 through 67, 130, 149, 190, 198, 234, 236 and 619.

     SECTION 21. [NEW MATERIAL] REPRESENTATIVE DISTRICT FIFTEEN.--Representative district fifteen is composed of Bernalillo county precincts 4 through 10, 18, 86, 108, 180, 219, 220, 238, 259, 410, 418, 422, 423, 448, 458 through 460, 485, 510, 589, 590, 661, 664, 668, 669, 674, 682 and 683.

     SECTION 22. [NEW MATERIAL] REPRESENTATIVE DISTRICT SIXTEEN.--Representative district sixteen is composed of Bernalillo county precincts 23, 25 through 28, 34 through 40, 55, 119, 156, 157, 167 through 169, 189, 199, 210, 233, 263, 607, 616, 618 and 633.

     SECTION 23. [NEW MATERIAL] REPRESENTATIVE DISTRICT SEVENTEEN.--Representative district seventeen is composed of Bernalillo county precincts 11 through 17, 126, 182, 191 through 196, 218, 257, 277, 279, 346, 347, 369, 375, 409, 438, 439, 455, 581, 651 and 666.

     SECTION 24. [NEW MATERIAL] REPRESENTATIVE DISTRICT EIGHTEEN.--Representative district eighteen is composed of Bernalillo county precincts 214 through 216, 241 through 245, 251 through 256, 258, 273, 274, 278, 338, 341 through 344, 351 through 353, 355 through 358, 363 and 381 through 384.

     SECTION 25. [NEW MATERIAL] REPRESENTATIVE DISTRICT NINETEEN.--Representative district nineteen is composed of Bernalillo county precincts 271, 272, 275, 280 through 287, 311, 312, 318, 321 through 323, 326, 327, 336, 337, 378, 379 and 591.

     SECTION 26. [NEW MATERIAL] REPRESENTATIVE DISTRICT TWENTY.--Representative district twenty is composed of Bernalillo county precincts 289, 290, 293 through 299, 301, 302, 319, 320, 324, 325, 328 through 332, 334, 335, 348 through 350, 656 through 658 and 660.

[NEW MATERIAL] REPRESENTATIVE DISTRICT FORTY-NINE.--Representative district forty-nine is composed of Catron county precincts 1 through 6, 8 and 9; Sierra county precincts 2 through 12; Socorro county precincts 1 through 14, 16 through 23 and 25 through 27; and Valencia county precincts 20, 33 and 46.

     SECTION 56. [NEW MATERIAL] REPRESENTATIVE DISTRICT FIFTY.--Representative district fifty is composed of Santa Fe county precincts 13 through 17, 37, 54, 57, 63, 65, 68 through 72, 81, 88, 94, 103, 107, 110 through 114, 126, 129, 134, 139, 150, 156, 161, 165 through 168, 171 and 175.

     SECTION 58. [NEW MATERIAL] REPRESENTATIVE DISTRICT FIFTY-TWO.--Representative district fifty-two is composed of Dona Ana county precincts 5 through 9, 64, 66, 71, 73, 77, 79, 96, 104, 110, 114, 120, 132, 133, 149 and 152 through 154; and Otero county precincts 16, 35, 59 and 60.

     SECTION 68. [NEW MATERIAL] REPRESENTATIVE DISTRICT SIXTY-TWO.--Representative district sixty-two is composed of Lea county precincts 10, 18 through 31, 37 through 41, 56 and 57.

     SECTION 71. [NEW MATERIAL] REPRESENTATIVE DISTRICT SIXTY-FIVE.--Representative district sixty-five is composed of Rio Arriba county precincts 1 through 3 and 21 through 23; Sandoval county precincts 1 through 4, 6, 8, 9, 14, 15, 17, 19 through 27, 29, 77, 87, 88, 91 and 95; and San Juan county precinct 15.

     SECTION 72. [NEW MATERIAL] REPRESENTATIVE DISTRICT SIXTY-SIX.--Representative district sixty-six is composed of Chaves county precincts 1 through 5, 7, 8, 40, 41, 44, 45, 47 and 73; Lea county precincts 2, 3, 8, 9, 11 through 14, 16 and 17; and Roosevelt county precincts 2 through 5, 10, 11, 14 through 16, 19 and 21.

     SECTION 73. [NEW MATERIAL] REPRESENTATIVE DISTRICT SIXTY-SEVEN.--Representative district sixty-seven is composed of Colfax county; Curry county precincts 1 through 4, 16 and 34; Harding county; Mora county precinct 11; Quay county; San Miguel county precincts 14, 15 and 33; and Union county.

     SECTION 74. [NEW MATERIAL] REPRESENTATIVE DISTRICT SIXTY-EIGHT.--Representative district sixty-eight is composed of Bernalillo county precincts 19, 68, 69, 79, 82, 85, 87, 116, 128, 129, 170, 174 through 177, 179, 200, 201, 203, 222, 230, 261, 610, 623, 624, 628, 637, 641, 643 through 645 and 686; and Sandoval county precincts 138 and 157.

     SECTION 75. [NEW MATERIAL] REPRESENTATIVE DISTRICT SIXTY-NINE.--Representative district sixty-nine is composed of Bernalillo county precincts 31, 88 and 93; Cibola county precincts 2 through 4, 9 through 11, 18 through 25 and 27; McKinley county precincts 9 through 14, 16, 60, 62 and 71; San Juan county precinct 14; and Valencia county precinct 13.

     SECTION 76. [NEW MATERIAL] REPRESENTATIVE DISTRICT SEVENTY.--Representative district seventy is composed of Mora county precincts 1 through 10; and San Miguel county precincts 1 through 13, 16 through 32 and 34.

     SECTION 77. [NEW MATERIAL] ELECTION OF REPRESENTATIVES.--Representatives shall be elected from the districts described in the 2021 House Redistricting Act at the 2022 and subsequent general elections.

     SECTION 78. TEMPORARY PROVISION--COMPILATION INSTRUCTIONS.--The compiler shall remove from the NMSA 1978 the provisions of Section 2-7E-1 NMSA 1978 (copy of state house of representative districts established in Egolf v. Duran, D-101-CV-2011-02942 (1st Dist. Ct., Judgment and Final Order on Remand (State House of Representatives Trial) filed February 28, 2012)).

     SECTION 79. REPEAL.--Sections 2-7C-1 through 2-7C-78 NMSA 1978 (being Laws 1991 (1st S.S.), Chapter 2, Sections 1 through 78) are repealed.
