HOUSE FLOOR AMENDMENT number ___1__ to HOUSE JOINT RESOLUTION 12

Amendment sponsored by Representative Daymon Ely

    1. On page 1, line 25, after "commissioners", insert ", who shall be appointed with due regard to geographic diversity".

    2. On page 2, line 1, after "party", insert "and shall not have changed their party affiliation within two years of appointment".

    3. On page 2, line 3, strike "who" and strike line 4 up to the period.

    4. On page 2, line 5, after "appoint", strike the remainder of the line and strike line 6 up to the period and insert in lieu thereof "one commissioner".

    5. On page 2, line 8, strike "One", strike lines 9 through 11 in their entirety and strike line 12 up to the period and insert in lieu thereof "One commissioner each shall be appointed by the minority floor leaders of the senate and of the house of representatives".

    6. On page 2, lines 19 and 20, strike Paragraph (4) in its entirety.

    7. Renumber the succeeding paragraphs accordingly.

    8. On page 3, line 1, strike "(6)" and insert in lieu thereof "(5)".

    9. On page 3, line 8, strike "and" and insert in lieu thereof a comma and after "judges", insert "and magistrates".

    10. On page 3, line 9, after the semicolon, insert "and".

    11. On page 3, strike lines 10 and 11 in their entirety.

    12. Renumber the succeeding paragraph accordingly.

    13. On page 4, between lines 15 and 16, insert the following:

    "SECTION 3. It is proposed to amend Article 6, Section 26 of the constitution of New Mexico to read:

    "The legislature shall establish a magistrate court to exercise limited original jurisdiction as may be provided by law. The magistrate court shall be composed of such districts and elective magistrates as may be provided by law. Magistrates shall be qualified electors of, and reside in, their respective districts, and the legislature shall prescribe other qualifications. [Magistrates shall receive compensation as may be provided by law, which compensation shall not be diminished during their term of office] Metropolitan court judges shall be chosen as provided in this constitution."".

    14. Renumber the succeeding sections accordingly.

    15. On page 5, line 23, strike "4" and insert in lieu thereof "5".
