AN ACT

RELATING TO THE PREVENTION OF CONGENITAL SYPHILIS IN INFANTS; REQUIRING PHYSICIANS TO TEST A PREGNANT WOMAN FOR SYPHILIS PURSUANT TO FEDERAL CENTERS FOR DISEASE CONTROL AND PREVENTION TESTING GUIDELINES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 24-1-10 NMSA 1978 (being Laws 1973, Chapter 359, Section 10) is amended to read:

     "24-1-10. PREGNANCY--SEROLOGICAL TEST FOR SYPHILIS.--

          A. Every physician examining a pregnant woman for conditions relating to her pregnancy [during the period of gestation or at delivery or both shall take or cause to be taken a sample of blood of such woman at the time of first examination] shall take laboratory samples during pregnancy and at delivery pursuant to syphilis testing guidelines recommended by the federal centers for disease control and prevention.

          [B. All such blood samples shall be submitted to the state public health laboratory for a standard serological test for syphilis.

          C.] B. The standard serological test shall be a test [for syphilis approved by the director of the department. Such serological tests shall be made on request without charge by the department] recommended by the federal centers for disease control and prevention for the diagnosis and clinical staging of syphilis."
