AN ACT

RELATING TO MUNICIPALITIES; PROVIDING THAT A MAJORITY OF THE MEMBERS OF A GOVERNING BODY PRESENT AT A MEETING CAN ADOPT AN ORDINANCE OR RESOLUTION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 3-17-4 NMSA 1978 (being Laws 1965, Chapter 300, Section 14-16-3) is amended to read:

     "3-17-4. ORDINANCES--ROLL CALL VOTE--ADOPTION.--

          A. If a majority of [all] the members of the governing body present vote in favor of adopting [the] an ordinance or resolution, it is adopted. The municipal clerk shall record in the minutes book the vote of each member of the governing body on each ordinance or resolution.

          B. Within three days after the adoption of an ordinance or resolution, the mayor shall validate the ordinance or resolution by endorsing "Approved" upon the ordinance or resolution and signing the ordinance or resolution."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2021.
