Your LABOR, VETERANS' AND MILITARY AFFAIRS COMMITTEE, to whom has been referred
HOUSE BILL 268
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 2, line 9, after "2023", insert ", if the presumption in Subsection B of this section applies and is not rebutted pursuant to Subsection C of this section".
2. On page 2, line 17, strike "then existent".
3. On page 2, line 18, after "2019", insert "in effect at any time during the fourteen days prior to the diagnosis".
4. On page 3, lines 2 and 3, strike "in a court of competent jurisdiction".
5. On page 3, line 5, strike "then existent".
6. On page 3, line 6, after "2019", insert "in effect at any time during the fourteen days prior to the diagnosis".
7. On page 3, lines 7 through 13, strike Subsection D in its entirety and insert in lieu thereof the following:
"D. As used in this section, "essential employee" means any public safety employee, any school employee, any employee of any business declared to be an essential business pursuant to a public health order of the governor or the secretary of health, or any employee of a business that has been permitted to operate with limitations pursuant to a public health order of the governor or the secretary of health; provided that the employee was required to work at the physical location of employment at any time, up to twenty days prior to the diagnosis of coronavirus disease 2019; and provided further that the employee does not work for a business whose testing and tracing plans have been approved by the department of health."".,
and thence referred to the STATE GOVERNMENT, ELECTIONS AND INDIAN AFFAIRS COMMITTEE.
