AN ACT

RELATING TO CRIMINAL LAW; PROVIDING CRIMINAL PENALTIES FOR THE UNLAWFUL USE OF BODY ARMOR.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Criminal Code is enacted to read:

     "[NEW MATERIAL] UNLAWFUL USE OF BODY ARMOR PROHIBITED--PENALTY.--

          A. It is unlawful for a convicted felon to:

                (1) knowingly possess body armor; or

                (2) knowingly wear or otherwise use body armor during the commission of a felony.

          B. A convicted felon who knowingly possesses body armor is guilty of a fourth degree felony. A convicted felon who has not been convicted of a felony within ten years may possess body armor in the course of employment, provided that the body armor is surrendered to the employer upon the conclusion of employment.

          C. A convicted felon who knowingly wears or otherwise uses body armor during the commission of a felony is guilty of a third degree felony.

          D. For the purposes of this section, "body armor" means an article of clothing or piece of equipment designed in whole or in part to minimize the risk of injury from a deadly weapon."
