Your JUDICIARY COMMITTEE, to whom has been referred
HOUSE BILL 56
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 10, line 6, after the semicolon, strike the remainder of the line, strike lines 7 through 13 in their entirety and strike line 14 through the semicolon.
2. On page 10, between lines 17 and 18, insert the following new subsection:
"F. Notwithstanding the provisions of Subsection D or E of this section, a sex offender may petition the district court for an order excepting the individual from continued registration pursuant to the Sex Offender Registration and Notification Act; provided that:
(1) the sex offender completes the requirements of a conditional discharge. The court shall grant the petition upon a showing that the sex offender has completed all of the requirements of a conditional discharge; or
(2) if subject to the provisions of Paragraph (8) of Subsection E of this section, the individual shows that the individual would not have been required to register in New Mexico and the court finds good cause that the individual's registration will not advance public safety in New Mexico.".
3. Reletter the succeeding subsections accordingly.,
