Mr. President:
Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred
SENATE BILL 98
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 5, line 11, after the period, insert "Within thirty days after the filing of the complaint, either party may request in writing a mediation to resolve the complaint.
G.".
2. Reletter the succeeding subsections accordingly.
3. On page 5, line 14, strike the first occurrence of "of" and insert in lieu thereof "after the completion of mediation or, if no mediation is requested, within seventy-five days after".
4. On page 5, line 23, after the period, insert:
"Prior to issuing a determination, the director shall provide the contractor, subcontractor, employer or other person against whom the complaint has been filed with an opportunity to respond to the complaint and provide any exculpatory evidence.".
5. On page 6, line 17, after "required", strike the remainder of the line and strike line 18 through "parties".,
and thence referred to the JUDICIARY COMMITTEE.
