AN ACT
RELATING TO SCHOOL PERSONNEL; PROVIDING THAT SCHOOL EMPLOYEES TEACHING UNDER A NATIVE AMERICAN LANGUAGE AND CULTURE CERTIFICATE SHALL BE PAID AT THE SAME RATE AS LEVEL ONE TEACHERS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. Section 22-10A-13 NMSA 1978 (being Laws 2003, Chapter 153, Section 44) is amended to read:
"22-10A-13. NATIVE AMERICAN LANGUAGE AND CULTURE CERTIFICATES.--
A. The [state board] department may issue a Native American language and culture certificate to a person proficient in a Native American language and culture of a New Mexico tribe or pueblo who meets criteria established by the [state board] department pursuant to an agreement with the tribe or pueblo allowing its language to be taught in a public school, identifying tribal or pueblo members who are proficient in the language who may teach the language to public school students and approving the school programs in which the language will be taught. A baccalaureate degree is not required for the person applying for this certificate. The Native American language and culture certificate shall be issued and renewable in accordance with procedures established by the [state board] department.
B. A person teaching with a Native American language and culture certificate shall be paid the same salary as level one teachers."
SECTION 2. APPLICABILITY.--The provisions of this act apply to contracts entered into for the 2020-2021 school year and subsequent school years.
