Your LABOR, VETERANS AND MILITARY AFFAIRS COMMITTEE, to whom has been referred
HOUSE BILL 21
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 1, line 12, strike "OR SEXUAL ASSAULT" and insert in lieu thereof ", DISCRIMINATION OR RETALIATION".
2. On page 1, line 16, after "HARASSMENT", insert ", DISCRIMINATION".
3. On page 1, line 17, strike "SEXUAL ASSAULT" and insert in lieu thereof "RETALIATION".
4. On page 1, line 22, strike "or sexual assault" and insert in lieu thereof ", discrimination or retaliation".
5. On page 1, line 24, strike "or sexual assault" and insert in lieu thereof ", discrimination or retaliation".
6. On page 2, line 3, strike "or sexual assault" and insert in lieu thereof ", discrimination or retaliation".
7. On page 2, between lines 10 and 11, insert the following:
"C. At the sole request of the employee and not withstanding any other provisions of law, a settlement agreement subject to this section may contain a confidentiality provision that prevents the disclosure of factual information related to the underlying sexual harassment, discrimination or retaliation claim.
D. Except as provided in Subsection C of this section, a confidentiality provision in a settlement agreement subject to this section is void and unenforceable as a matter of law.".
8. On page 2, line 12, after "into", insert "between a private employer and an employee or former employee".,
and thence referred to the JUDICIARY COMMITTEE.
