A JOINT RESOLUTION
PROPOSING TO AMEND ARTICLE 2 OF THE CONSTITUTION OF NEW MEXICO TO CREATE A PARENTAL RIGHT TO DIRECT THE UPBRINGING, EDUCATION AND CARE OF A PARENT'S CHILDREN AND TO CHOOSE THE TYPE OF SCHOOL THE CHILDREN ATTEND.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. It is proposed to amend Article 2 of the constitution of New Mexico by adding a new section to read:
"A. Parents have the right to direct the upbringing, education and care of their children.
B. The parental right to direct education includes the right to choose, as an alternative to public education, private, religious or home schools and the right to make reasonable choices within public schools for the parent's child.
C. The state may only infringe upon these rights by demonstrating that its governmental interest as applied to a person is on the highest order and not otherwise served.
D. This section shall not be construed to apply to a parental action or decision that would end life."
SECTION 2. The amendment proposed by this resolution shall be submitted to the people for their approval or rejection at the next general election or at any special election prior to that date that may be called for that purpose.
