AN ACT

RELATING TO THE PUBLIC PEACE, HEALTH, SAFETY AND WELFARE; USING ONE-HALF PERCENT OF THE PERMANENT SCHOOL FUND FOR PRE-KINDERGARTEN.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] EARLY CHILDHOOD--DEPARTMENT DUTIES.--An additional one-half percent shall be distributed from the permanent school fund to provide pre-kindergarten through the public education department and the children, youth and families department to improve children's developmental readiness for elementary school. The additional distribution shall be appropriated to the departments by the legislature; provided that no additional distribution shall be made pursuant to this section in any fiscal year if the average of the year-end market values of the fund for the immediately preceding five calendar years is less than twelve billion five hundred million dollars ($12,500,000,000).

     SECTION 2. CONTINGENT EFFECTIVE DATE.--Section 1 of this act is contingent upon the passage and approval of a constitutional amendment by the qualified electors of the state and, if necessary, approval of that constitutional amendment by the United States congress, which allows for an additional distribution from the permanent school fund for pre-kindergarten.
