AN ACT

RELATING TO PUBLICATION OF NOTICE; AMENDING A SECTION OF THE NMSA 1978 PERTAINING TO ELECTRONIC POSTING OF A STATE AGENCY'S LEGAL NOTICES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 14-11-10.2 NMSA 1978 (being Laws 2003, Chapter 186, Section 1) is amended to read:

     "14-11-10.2. ELECTRONIC POSTING OF LEGAL NOTICES.--

          A. Legal notices and advertisements of a state agency shall be posted on the state agency's [web site] website. If a county, municipality, board of education or other political subdivision of the state has a [web site] website, it shall post its legal notices and advertisements on its [web site] website. Electronic posting is not a substitute for required publication of legal notices and advertisements [and failure to electronically post shall not constitute grounds to challenge, void, set aside or otherwise delay a proceeding properly noticed and advertised pursuant to nonelectronic notice requirements].

          B. Electronically posted legal notices and advertisements shall be indexed in such a way that the general public is able to easily find a particular legal notice or advertisement by subject."
