AN ACT

RELATING TO HEALTH COVERAGE; REQUIRING IMPLEMENTATION OF A TOBACCO USE CESSATION PROGRAM; REQUIRING COVERAGE FOR MEDICAID RECIPIENTS WHO ACCESS TOBACCO USE CESSATION PRESCRIPTIONS AS PART OF THE PROGRAM.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Public Assistance Act is enacted to read:

     "[NEW MATERIAL] TOBACCO USE CESSATION PROGRAM--MEDICAID COVERAGE.--The department shall implement a comprehensive tobacco use cessation program and, by January 1, 2020, promulgate rules to govern the program that include requirements that:

          A. medical assistance coverage include any medication that has been approved by the United States food and drug administration for tobacco use cessation treatment and that was prescribed to a recipient who participates in the program;

          B. the department evaluate tobacco cessation medications when those medications are approved by the United States food and drug administration and provide access to those medications through the program, as necessary; and

          C. the department conduct periodic reviews of and collect data related to the program and prepare an annual report on the program, including any recommendations for possible improvements to the program."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2019.
