Mr. President:
Your JUDICIARY COMMITTEE, to whom has been referred
SENATE BILL 331
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 1, line 13, strike "SUSPEND" and insert in lieu thereof "SANCTION" and after "BODY" insert ", WHICH MAY INCLUDE CORRECTIVE ACTION AND SUSPENSION".
2. On page 3, line 12, after "nepotism", insert ", including identifying who the supervisor of record will be".
3. On page 4, strike Subsection G in its entirety and insert in lieu thereof a new Subsection G to read:
"G. oversee the governing body's compliance with federal and state laws and, if necessary, take action following the appropriate steps when the governing body is not operating pursuant to law or is violating policies and procedures in the charter;".
4. On pages 5 through 7, strike Section 3 in its entirety.
5. Renumber the succeeding sections accordingly.
6. On page 12, line 22, strike "SUSPEND" and insert in lieu thereof "SANCTION".
7. On page 12, line 25, strike "coming".
8. On page 13, line 1, after "jurisdiction", insert a period and strike the remainder of the page and all of page 14 and insert in lieu thereof:
"If a charter school's performance or legal compliance is unsatisfactory, the chartering authority shall promptly notify the charter school of the perceived problem and provide a reasonable opportunity for the school to remedy the problem, unless the problem warrants revocation, in which case revocation procedures shall be followed. Every chartering authority may exercise sanctions short of revocation in response to deficiencies in charter school performance or legal compliance. Such actions or sanctions may include, if warranted, requiring a school to develop and execute a corrective action plan within a specified time. The chartering authority shall follow its own policy on suspension, revocation or nonrenewal."".
