FOR THE LEGISLATIVE EDUCATION STUDY COMMITTEE

 

AN ACT

RELATING TO CRIME; CREATING THE CRIME OF MAKING A SCHOOL THREAT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Criminal Code is enacted to read:

     "[NEW MATERIAL] MAKING A SCHOOL THREAT.--

          A. It is unlawful for a person to make a school threat.

          B. Whoever commits making a school threat is guilty of a fourth degree felony.

          C. As used in this section, "school threat" means a threat to commit any offense involving violence to a person on school property, or to harm school property, that is unequivocal, unconditional and specific so as to convey a gravity of purpose and the immediate prospect of execution with intent to:

                (1) cause a reaction of any type to the threat by an official or volunteer agency organized to deal with emergencies;

                (2) place a person in fear of great bodily harm; or

                (3) prevent or interrupt the occupation or use of a school building."
