Mr. Speaker:

    Your HEALTH & HUMAN SERVICES COMMITTEE, to whom has been referred

HOUSE BILL 422

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 4, lines 17 through 24, strike Paragraph (1) in its entirety and insert in lieu thereof the following new paragraph:

          "(1) members who are individuals with developmental disabilities or parents, immediate relatives or legal guardians of individuals with developmental disabilities comprising at least sixty percent of the council's membership, provided that:

                (a) no more than three of these members are primarily served by the same developmental disabilities service provider;

                (b) none of these members shall be an employee, contractor or board member of a service provider that receives funds from the council or the department to provide developmental disabilities supports and services; and

                (c) as long as the council operates the office of guardianship, pursuant to Section 28-16B-2 NMSA 1978, none of these members shall be an employee, contractor or board member of an agency that provides guardianship, conservatorship or mental health treatment guardianship services;".

     2. On page 16, line 9, strike "28-16A-9" and insert in lieu thereof "28-16A-8".

     3. On page 16, line 10, strike "9" and insert in lieu thereof "8".,

and thence referred to the STATE GOVERNMENT, ELECTIONS & INDIAN AFFAIRS COMMITTEE.
