AN ACT

RELATING TO STATE RESOURCES; PROHIBITING THE USE OF STATE LAND FOR THE CONSTRUCTION OR REPLACEMENT OF A BARRIER ORDERED OR SOUGHT BY THE FEDERAL GOVERNMENT ON THE STATE'S BORDER WITH MEXICO; PROHIBITING THE USE OF STATE RESOURCES TO BE USED FOR THE CONSTRUCTION OR REPLACEMENT OF A WALL OR BARRIER ON THE BORDER BETWEEN THE UNITED STATES AND MEXICO; DECLARING AN EMERGENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] NO STATE LAND FOR A NEW BORDER BARRIER.--No real property owned or held in trust by the state shall be used, sold, leased, eased, transferred or otherwise disposed of for use as a site for the construction or the replacement of a new barrier ordered or sought by the federal government on the border of the state of New Mexico and the Mexican states of Chihuahua and Sonora. This section shall not prevent the construction of a barrier to prevent the movement of livestock.

     SECTION 2. [NEW MATERIAL] PROHIBIT THE USE OF STATE RESOURCES FOR THE CONSTRUCTION OR REPLACEMENT OF A WALL OR BARRIER ON THE BORDER BETWEEN THE UNITED STATES AND MEXICO.--No state resources shall be used to award or renew a contract for goods or services with an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture or any legal or commercial entity that at the time of bid or proposal for a new contract or renewal of an existing contract is providing or has provided goods or services to the federal government for the construction or replacement of a federally funded infrastructure project wall, fence or other barrier along New Mexico's international border with Mexico.

     SECTION 3. APPLICABILITY.--The provisions of this act apply to state resources and to real property owned or held in trust by the state on or after the effective date of this act.

     SECTION 4. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
