AN ACT

RELATING TO CRIME; CREATING THE CRIME OF MAKING A TERRORISTIC THREAT.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Criminal Code is enacted to read:

     "[NEW MATERIAL] MAKING A TERRORISTIC THREAT.--

          A. It is unlawful for a person to make a terroristic threat.

          B. Whoever commits making a terroristic threat is guilty of a fourth degree felony.

          C. As used in this section, "terroristic threat" means a threat to commit any offense involving violence to a person or to property that is unequivocal, unconditional and specific so as to convey a gravity of purpose and the immediate prospect of execution with intent to:

                (1) cause a reaction of any type to the threat by an official or volunteer agency organized to deal with emergencies;

                (2) place a person in fear of great bodily harm;

                (3) prevent or interrupt the occupation or use of a building, room, place of assembly, place to which the public has access, place of employment or occupation, aircraft, automobile or other form of conveyance or other public place;

                (4) cause impairment or interruption of public communications, public transportation, public water, a public gas or power supply or other public service; or

                (5) influence the conduct or activities of a branch or agency of the federal government, the state or a political subdivision of the state."
