AN ACT
RELATING TO HEALTH; ENACTING THE HEPATITIS C REGISTRY ACT; CREATING A HEPATITIS C REGISTRY AT THE UNIVERSITY OF NEW MEXICO HEALTH SCIENCES CENTER; ESTABLISHING THE HEPATITIS C REGISTRY FUND IN THE STATE TREASURY; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be cited as the "Hepatitis C Registry Act".
SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the Hepatitis C Registry Act:
A. "center" means the clinical and translational science center bioinformatics group of the university of New Mexico health sciences center;
B. "chancellor" means the chancellor for health sciences of the university of New Mexico;
C. "director" means the director of the registry; and
D. "registry" means the hepatitis C registry created and operated pursuant to the Hepatitis C Registry Act.
SECTION 3. [NEW MATERIAL] UNIVERSITY OF NEW MEXICO HEALTH SCIENCES CENTER--HEPATITIS C REGISTRY.--The "hepatitis C registry" is created at the clinical and translational science center of the university of New Mexico health sciences center. The center shall use the registry to monitor and measure progress in hepatitis C elimination among New Mexico residents statewide, including the number of individuals tested, treated and cured of hepatitis C and related conditions. The center shall use the registry to store the following information:
A. demographic information relating to individuals exposed to the hepatitis C virus, including each individual's:
(1) age;
(2) gender;
(3) ethnicity;
(4) race; and
(5) zip code or other geolocation indicator;
B. clinical data relating to individuals believed to have been exposed or known to have been exposed to the hepatitis C virus, including:
(1) the results of testing relating to diagnosis and treatment of hepatitis C and related conditions;
(2) treatment data, including whether an individual has been treated for hepatitis C; the type of treatments administered; and treatment outcomes;
(3) liver function tests; and
(4) hepatitis B vaccinations; and
C. information relating to sites treating hepatitis C, including:
(1) the zip code or other geolocation indicator; and
(2) the profession and specialty of the health care provider.
SECTION 4. [NEW MATERIAL] REGISTRY DIRECTOR--ACCESS--STANDARD OPERATING PROCEDURES.--
A. The chancellor shall appoint a director of the registry. Access to the registry shall be limited to:
(1) individuals and entities that the chancellor approves for access; and
(2) the hepatitis C research group of the university of New Mexico health sciences center.
B. The director shall establish standard operating procedures for access to and use and storage of information in the registry.
SECTION 5. [NEW MATERIAL] HEPATITIS C REGISTRY FUND--CREATION.--The "hepatitis C registry fund" is created in the state treasury. The fund consists of state general fund appropriations. Money in the fund shall not revert to any other fund at the end of a fiscal year. The board of regents of the university of New Mexico shall administer the fund, and money in the fund is appropriated to the board of regents of the university of New Mexico to carry out the provisions of the Hepatitis C Registry Act. Money in the fund shall be disbursed on warrants signed by the secretary of finance and administration pursuant to vouchers signed by the board of regents of the university of New Mexico or the board's authorized representative.
