AN ACT
RELATING TO CONSTRUCTION; REQUIRING NOTICE OF PROPOSED CONSTRUCTION BENEATH A MILITARY TRAINING FLIGHT PATH.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of the Construction Industries Licensing Act is enacted to read:
"[NEW MATERIAL] NOTICE OF PROPOSED CONSTRUCTION BENEATH A MILITARY TRAINING FLIGHT PATH.--At least forty-five days prior to issuing a construction permit for construction on real property located beneath a military training flight path as identified on a map provided by a commander of a military installation located in whole or in part in New Mexico, the issuing agency shall provide notice to the commander of the request for a construction permit. The notice shall identify the location of the real property and the proposed construction plans."
SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2017.
