AN ACT

RELATING TO CRIME; MODIFYING THE CRIME OF CONCEALING IDENTITY; PROVIDING A PENALTY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 30-22-3 NMSA 1978 (being Laws 1963, Chapter 303, Section 22-3) is amended to read:

     "30-22-3. CONCEALING IDENTITY.--

          A. Concealing identity consists of:

                (1) concealing one's true name or identity [or disguising oneself] with intent to obstruct the due execution of the law or with intent to intimidate, hinder or interrupt [any] a public officer [or any other person] in a legal performance of [his] the officer's duty or the exercise of [his] the officer's rights under the laws of the United States or of this state; or

                (2) disguising oneself with a mask or some other costume with the intent to intimidate, hinder or interrupt a person in the exercise of the person's rights under the laws of the United States or of this state.

          B. Whoever commits concealing [identify] identity:

                (1) as provided in Paragraph (1) of Subsection A of this section is guilty of a petty misdemeanor; and

                (2) as provided in Paragraph (2) of Subsection A of this section is guilty of a misdemeanor."
